共同共有是什么意思

1、產生的依據不同

在(zai)按份(fen)共(gong)有(you)(you)中,各共(gong)有(you)(you)權(quan)人(ren)(ren)可(ke)以自由處(chu)分共(gong)有(you)(you)房(fang)產中屬于自己的份(fen)額,而無需(xu)征得其他(ta)共(gong)有(you)(you)人(ren)(ren)的同(tong)意,其他(ta)共(gong)有(you)(you)人(ren)(ren)只能在(zai)同(tong)等條件下享有(you)(you)優先購買權(quan)。

共同共有的房子如何確定份額
1、我國《民法典(dian)》對(dui)共(gong)同(tong)共(gong)有(you)份(fen)額的(de)(de)規定(ding):將按(an)份(fen)共(gong)有(you)作為共(gong)有(you)的(de)(de)常態。共(gong)同(tong)共(gong)有(you)是不分份(fen)額的(de)(de)共(gong)有(you)。
2、房屋的所有(you)權(quan)不劃分所有(you)權(quan)份額,各(ge)所有(you)權(quan)人享有(you)平等的權(quan)利。
