共同共有是什么意思

1、產生的依據不同

2、享有權利的范圍不同

3、對共有房屋的處分方式不同
根(gen)據《民法典》規定:“按(an)份(fen)共(gong)(gong)有(you)(you)財產(chan)的(de)每(mei)個(ge)共(gong)(gong)有(you)(you)人有(you)(you)權(quan)要求將自己(ji)的(de)份(fen)額分出(chu)或者(zhe)轉(zhuan)讓(rang),但在出(chu)售時,其(qi)他共(gong)(gong)有(you)(you)人在同等條件下,有(you)(you)優先(xian)購(gou)買的(de)權(quan)利。”;“按(an)份(fen)共(gong)(gong)有(you)(you)人可(ke)以轉(zhuan)讓(rang)其(qi)享有(you)(you)的(de)共(gong)(gong)有(you)(you)的(de)不動(dong)產(chan)或者(zhe)動(dong)產(chan)份(fen)額。其(qi)他共(gong)(gong)有(you)(you)人在同等條件下享有(you)(you)優先(xian)購(gou)買的(de)權(quan)利。”
在按份共(gong)(gong)有(you)中(zhong),各共(gong)(gong)有(you)權人(ren)可以自(zi)由處分(fen)共(gong)(gong)有(you)房(fang)產中(zhong)屬(shu)于自(zi)己(ji)的份額,而(er)無需征得其(qi)他共(gong)(gong)有(you)人(ren)的同(tong)(tong)意(yi),其(qi)他共(gong)(gong)有(you)人(ren)只能在同(tong)(tong)等條件下享(xiang)有(you)優先購買權。
而共同共有的房屋,共有人要對共有房產進行處分時,必須(xu)取得(de)全體共有人的(de)(de)同意(yi)或者占份額三分之(zhi)二以上的(de)(de)人同意(yi),否則,部分共有人擅自處分的(de)(de)共有房產,一般情況下都認(ren)定為無效。
共同共有的房子如何確定份額
1、我國(guo)《民法典》對共(gong)同共(gong)有(you)份額的(de)規定(ding):將按份共(gong)有(you)作為(wei)共(gong)有(you)的(de)常(chang)態。共(gong)同共(gong)有(you)是(shi)不分份額的(de)共(gong)有(you)。
2、房屋的所有權(quan)不劃分(fen)所有權(quan)份額(e),各所有權(quan)人享(xiang)有平等的權(quan)利。
3、除(chu)法律(lv)規定或當(dang)事(shi)人另有(you)(you)(you)約(yue)定外,不能對(dui)房(fang)屋進(jin)(jin)行(xing)分(fen)(fen)割(ge)(ge),不能終止(zhi)房(fang)屋共(gong)有(you)(you)(you)關系。只有(you)(you)(you)出(chu)現法定或約(yue)定事(shi)由,導致共(gong)同(tong)(tong)關系歸于消滅時,共(gong)有(you)(you)(you)人才能對(dui)財產進(jin)(jin)行(xing)分(fen)(fen)割(ge)(ge)。例如:夫妻財產的(de)分(fen)(fen)割(ge)(ge),只有(you)(you)(you)在婚(hun)姻關系解除(chu)時,才能對(dui)共(gong)同(tong)(tong)財產進(jin)(jin)行(xing)分(fen)(fen)割(ge)(ge)。
