房屋共有產權人是怎么規定的

按我國《婚姻法》的規定,夫妻雙方婚姻關系存續期間所得的房屋,歸夫妻雙方共同所有,除非夫妻雙方有特別約定。出售夫妻雙方(fang)共同(tong)(tong)(tong)所(suo)(suo)有的(de)(de)(de)房(fang)屋時(shi),應當(dang)取得產(chan)(chan)權(quan)證上(shang)登(deng)記(ji)的(de)(de)(de)房(fang)屋產(chan)(chan)權(quan)人(ren)(房(fang)主(zhu))的(de)(de)(de)配偶(ou)的(de)(de)(de)同(tong)(tong)(tong)意。如(ru)果是(shi)(shi)此套房(fang)產(chan)(chan)是(shi)(shi)夫妻共同(tong)(tong)(tong)財(cai)產(chan)(chan),即(ji)使房(fang)產(chan)(chan)證上(shang)只寫一(yi)(yi)方(fang)的(de)(de)(de)名字,另(ling)一(yi)(yi)方(fang)也是(shi)(shi)共有產(chan)(chan)權(quan)人(ren)。在轉(zhuan)讓時(shi),應征得另(ling)一(yi)(yi)方(fang)的(de)(de)(de)同(tong)(tong)(tong)意;如(ru)果是(shi)(shi)夫妻一(yi)(yi)方(fang)婚前的(de)(de)(de)個人(ren)財(cai)產(chan)(chan)或是(shi)(shi)雙方(fang)婚后就此房(fang)產(chan)(chan)約定為(wei)其中一(yi)(yi)方(fang)的(de)(de)(de)個人(ren)財(cai)產(chan)(chan)的(de)(de)(de),所(suo)(suo)屬方(fang)是(shi)(shi)有處分權(quan)的(de)(de)(de)。
房屋共同共有如何分割
共同共有的房屋可以(yi)通(tong)過(guo)協商約定(ding)的(de)方式分割(ge)(ge)。分割(ge)(ge)時,應(ying)先(xian)確定(ding)各共有人(ren)的(de)所有權份額,使共同共有轉變為按份共有,然(ran)后按按份共有的(de)方式進行分割(ge)(ge)。確定(ding)各所有人(ren)的(de)份額,應(ying)本(ben)著協商一致(zhi)的(de)原(yuan)則,各所有人(ren)均應(ying)本(ben)著團(tuan)結(jie)和睦(mu)、互助互讓(rang)的(de)精(jing)神進行協商,以(yi)求(qiu)達成一致(zhi)的(de)意見。
【法律依據】《民法(fa)典(dian)》第(di)一(yi)千(qian)零八十七條,離婚時(shi),夫妻的共同(tong)財(cai)產(chan)由雙(shuang)方協議處理協議不成的,由人民法(fa)院根(gen)據財(cai)產(chan)的具體(ti)情況,按照(zhao)照(zhao)顧子女(nv)、女(nv)方和(he)無過錯方權(quan)益(yi)的原則判決(jue)。對夫或(huo)者妻在家庭土地承包經營(ying)中享有(you)的權(quan)益(yi)等,應當依法(fa)予以保護。
房屋共有產權人可以不是夫妻嗎
不一(yi)定是夫妻,只要兩人姓名都在房(fang)產證上,兩人就是該住房(fang)共有人。
房屋共有產權人過世怎么辦
可以通過繼承來辦理房產過戶:
(一)辦(ban)理(li)房(fang)產證過(guo)戶(hu)手(shou)續要到被繼承(cheng)人戶(hu)籍(ji)所在地的(de)派出(chu)所注(zhu)銷戶(hu)籍(ji),辦(ban)理(li)死亡證明:
(二)辦理房產證過戶手續要到區或市公證處(原外銷商品房到市公證處)辦理繼(ji)承(cheng)權公證(zheng),房產繼(ji)承(cheng)分兩(liang)種:一是遺囑繼(ji)承(cheng),二(er)是法定繼(ji)承(cheng)。需要(yao)提交的材料有(you):

有遺囑的繼承權公證另需提交的資料:被繼承人所立遺囑(該遺囑(zhu)(zhu)必(bi)須是(shi)已公證過的遺囑(zhu)(zhu),其他形式的遺囑(zhu)(zhu)由于無法認定其真(zhen)實性,因此暫(zan)不予(yu)采(cai)納)。
(三)辦理房屋(wu)過戶(hu)登記,申請人(ren)是(shi)繼承人(ren)或者受遺(yi)贈(zeng)人(ren)。
申請人應當向登(deng)記機構提交(jiao)下列(lie)文(wen)件:《房地產登(deng)記申請書(shu)》(原(yuan)件)、身(shen)份證(zheng)(zheng)明(復印件)、房地產權證(zheng)(zheng)書(shu)(原(yuan)件)、繼承(cheng)權公證(zheng)(zheng)文(wen)書(shu)或者遺囑公證(zheng)(zheng)書(shu)和接受遺贈公證(zheng)(zheng)書(shu)(原(yuan)件)或契稅完稅憑證(zheng)(zheng)(原(yuan)件)。
(四)遺贈和法定(ding)繼承(cheng)、遺囑繼承(cheng)不同(tong),需(xu)要支付稅收(shou)。
