勞動合同期限有哪些分類
1、固定期限勞動合同
是指用人單位與勞動者約定合同終止時間的勞動合同。用人單位與勞動者協商一致,可以訂立固定期限勞動合同。固定期限的勞動合同可以是較短的半年、2年,也可以是較(jiao)長的5年、10年,具體期限長短應根據(ju)用(yong)人(ren)單位情(qing)況、崗位情(qing)況和勞(lao)動(dong)者情(qing)況自主確定。
2、無固定期限勞動合同
是指用(yong)(yong)人(ren)單位與勞(lao)動者約定(ding)無(wu)確定(ding)終止時(shi)間(jian)的勞(lao)動合(he)同(tong)。用(yong)(yong)人(ren)單位與勞(lao)動者協商一致(zhi),可以訂立(li)無(wu)固定(ding)期限勞(lao)動合(he)同(tong)。
有下列情形之一,勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)提出或(huo)者(zhe)(zhe)同意續(xu)簽、訂立勞(lao)(lao)動(dong)(dong)合同的,除勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)提出訂立固定(ding)期(qi)限(xian)勞(lao)(lao)動(dong)(dong)合同外(wai),否則應當訂立無固定(ding)期(qi)限(xian)勞(lao)(lao)動(dong)(dong)合同:
①勞動者(zhe)在該用人單(dan)位連續工作滿十年的(de);
②用人單位初次實行勞(lao)(lao)動合同制(zhi)度或者國有重新訂立勞(lao)(lao)動合同時,勞(lao)(lao)動者在(zai)該用人單位連續工作滿十(shi)年(nian)且距(ju)法定退休年(nian)齡不足十(shi)年(nian)的;
③連續(xu)訂(ding)立二次固定期限勞(lao)動(dong)合同(tong),且(qie)勞(lao)動(dong)者沒有勞(lao)動(dong)規定的用人(ren)單(dan)位可以的情(qing)形,續(xu)訂(ding)勞(lao)動(dong)合同(tong)的。
此外,用人(ren)單位自用工之日起,滿一(yi)年不與勞動者訂立書面勞動合(he)同的,視為用人(ren)單位與勞動者已訂立無(wu)固定期限勞動合(he)同。
3、以完成一定工作任務為期限的勞動合同
是指用人單(dan)位(wei)與勞(lao)動(dong)者約定以(yi)(yi)某項工作的完成(cheng)為合(he)同(tong)(tong)期限(xian)的勞(lao)動(dong)合(he)同(tong)(tong)。用人單(dan)位(wei)與勞(lao)動(dong)者協商一致,可以(yi)(yi)訂立以(yi)(yi)完成(cheng)一定工作任務為期限(xian)的勞(lao)動(dong)合(he)同(tong)(tong)。
勞動合同期限和試用期的規定
1、勞動(dong)(dong)合同(tong)(tong)期(qi)(qi)限三個月(yue)以上不(bu)(bu)滿一(yi)年(nian)的,試用期(qi)(qi)不(bu)(bu)得(de)超(chao)(chao)過一(yi)個月(yue);勞動(dong)(dong)合同(tong)(tong)期(qi)(qi)限一(yi)年(nian)以上不(bu)(bu)滿三年(nian)的,試用期(qi)(qi)不(bu)(bu)得(de)超(chao)(chao)過二個月(yue);三年(nian)以上固定(ding)期(qi)(qi)限和(he)無固定(ding)期(qi)(qi)限的勞動(dong)(dong)合同(tong)(tong),試用期(qi)(qi)不(bu)(bu)得(de)超(chao)(chao)過六個月(yue)。
2、同(tong)一用(yong)人單位與(yu)同(tong)一勞(lao)動(dong)(dong)者只(zhi)能約定一次試用(yong)期(qi)(qi)(qi)(qi)。以完(wan)成一定工作(zuo)任務為期(qi)(qi)(qi)(qi)限的勞(lao)動(dong)(dong)合(he)同(tong)或(huo)者勞(lao)動(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)(qi)限不滿三個月的,不得約定試用(yong)期(qi)(qi)(qi)(qi)。試用(yong)期(qi)(qi)(qi)(qi)包含(han)在勞(lao)動(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)(qi)限內。勞(lao)動(dong)(dong)合(he)同(tong)僅(jin)約定試用(yong)期(qi)(qi)(qi)(qi)的,試用(yong)期(qi)(qi)(qi)(qi)不成立,該期(qi)(qi)(qi)(qi)限為勞(lao)動(dong)(dong)合(he)同(tong)期(qi)(qi)(qi)(qi)限。
3、勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)期限是(shi)指合(he)(he)同(tong)(tong)的(de)有效(xiao)時(shi)(shi)間,它一般始(shi)于合(he)(he)同(tong)(tong)的(de)生效(xiao)之日,終于合(he)(he)同(tong)(tong)的(de)終止之時(shi)(shi)。任何勞(lao)(lao)動(dong)過程(cheng),都是(shi)在一定(ding)的(de)時(shi)(shi)間和空間中進行(xing)的(de)。在現代化(hua)社(she)會中,勞(lao)(lao)動(dong)時(shi)(shi)間被認為是(shi)衡(heng)量勞(lao)(lao)動(dong)效(xiao)率和成果的(de)一把(ba)尺子。勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)期限由用人單(dan)位和勞(lao)(lao)動(dong)者協商確定(ding)。是(shi)勞(lao)(lao)動(dong)合(he)(he)同(tong)(tong)的(de)一項重要內容,有著十(shi)分重要的(de)作用。
