勞動合同期限有哪些分類
1、固定期限勞動合同
是指用人單位與勞動者約定合同終止時間的勞動合同。用人單位與勞動者協商一致,可以訂立固定期限勞動合同。固定期限的勞動合同可以是較短的半年、2年,也可以是較長的5年、10年,具體期限長短應(ying)根據用(yong)人單位情(qing)(qing)況、崗(gang)位情(qing)(qing)況和勞動者情(qing)(qing)況自主(zhu)確定。
2、無固定期限勞動合同
是(shi)指用人(ren)單(dan)位(wei)與勞(lao)動(dong)者約定(ding)無確定(ding)終止(zhi)時間的(de)勞(lao)動(dong)合(he)同。用人(ren)單(dan)位(wei)與勞(lao)動(dong)者協商一致,可(ke)以訂立無固定(ding)期限勞(lao)動(dong)合(he)同。
有(you)下列(lie)情形之(zhi)一(yi),勞(lao)(lao)動(dong)者提(ti)出或(huo)者同(tong)意續簽、訂(ding)立(li)勞(lao)(lao)動(dong)合同(tong)的,除勞(lao)(lao)動(dong)者提(ti)出訂(ding)立(li)固定期限(xian)勞(lao)(lao)動(dong)合同(tong)外,否則應(ying)當訂(ding)立(li)無固定期限(xian)勞(lao)(lao)動(dong)合同(tong):
①勞(lao)動(dong)者在該(gai)用(yong)人單(dan)位連續工作滿(man)十年的;
②用(yong)人單(dan)位初次實(shi)行(xing)勞動合(he)同(tong)制(zhi)度(du)或者(zhe)國有重新訂立(li)勞動合(he)同(tong)時,勞動者(zhe)在該用(yong)人單(dan)位連續工(gong)作滿十年且距法定退休年齡不足(zu)十年的;
③連續訂(ding)立二次固定期限勞動(dong)合(he)同,且勞動(dong)者沒有勞動(dong)規定的用(yong)人單位可(ke)以的情形,續訂(ding)勞動(dong)合(he)同的。
此外,用人單位自用工之日起,滿一年不與勞動者(zhe)訂(ding)(ding)立書面勞動合(he)同的,視(shi)為(wei)用人單位與勞動者(zhe)已訂(ding)(ding)立無固定期限勞動合(he)同。
3、以完成一定工作任務為期限的勞動合同
是指用(yong)人(ren)(ren)單位(wei)與勞(lao)動(dong)(dong)者(zhe)約定以某項工作的完(wan)成(cheng)為(wei)合同期限的勞(lao)動(dong)(dong)合同。用(yong)人(ren)(ren)單位(wei)與勞(lao)動(dong)(dong)者(zhe)協商一致,可以訂立以完(wan)成(cheng)一定工作任(ren)務為(wei)期限的勞(lao)動(dong)(dong)合同。
勞動合同期限和試用期的規定
1、勞動(dong)合(he)同期限(xian)(xian)三個月(yue)(yue)以上不(bu)(bu)(bu)滿一年(nian)的(de),試(shi)用期不(bu)(bu)(bu)得(de)超(chao)(chao)過(guo)一個月(yue)(yue);勞動(dong)合(he)同期限(xian)(xian)一年(nian)以上不(bu)(bu)(bu)滿三年(nian)的(de),試(shi)用期不(bu)(bu)(bu)得(de)超(chao)(chao)過(guo)二個月(yue)(yue);三年(nian)以上固定(ding)期限(xian)(xian)和(he)無固定(ding)期限(xian)(xian)的(de)勞動(dong)合(he)同,試(shi)用期不(bu)(bu)(bu)得(de)超(chao)(chao)過(guo)六個月(yue)(yue)。
2、同(tong)(tong)一(yi)用(yong)(yong)人單位與同(tong)(tong)一(yi)勞(lao)(lao)動(dong)(dong)者(zhe)只能(neng)約定(ding)(ding)一(yi)次(ci)試(shi)用(yong)(yong)期(qi)(qi)(qi)。以完成(cheng)一(yi)定(ding)(ding)工作任務為期(qi)(qi)(qi)限(xian)的(de)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)或者(zhe)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)限(xian)不(bu)(bu)滿三個月的(de),不(bu)(bu)得約定(ding)(ding)試(shi)用(yong)(yong)期(qi)(qi)(qi)。試(shi)用(yong)(yong)期(qi)(qi)(qi)包含在勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)限(xian)內。勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)僅約定(ding)(ding)試(shi)用(yong)(yong)期(qi)(qi)(qi)的(de),試(shi)用(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)成(cheng)立,該(gai)期(qi)(qi)(qi)限(xian)為勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)期(qi)(qi)(qi)限(xian)。
3、勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期限是指(zhi)合(he)(he)同(tong)(tong)的有(you)效時(shi)間,它一般始于合(he)(he)同(tong)(tong)的生效之日,終(zhong)于合(he)(he)同(tong)(tong)的終(zhong)止(zhi)之時(shi)。任何勞動(dong)(dong)(dong)過程,都是在一定的時(shi)間和空間中(zhong)進行的。在現代化(hua)社會中(zhong),勞動(dong)(dong)(dong)時(shi)間被認(ren)為是衡量勞動(dong)(dong)(dong)效率和成果的一把尺子(zi)。勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期限由(you)用人單位和勞動(dong)(dong)(dong)者(zhe)協商確定。是勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的一項重(zhong)(zhong)要(yao)內容(rong),有(you)著十分重(zhong)(zhong)要(yao)的作用。
