《勞動(dong)(dong)法》第48條(tiao)規(gui)定,國家實(shi)行最(zui)(zui)低(di)工(gong)資(zi)(zi)(zi)保(bao)障制(zhi)度,最(zui)(zui)低(di)工(gong)資(zi)(zi)(zi)的具體標(biao)準由省、自治區、直轄市(shi)人民政府規(gui)定。原勞動(dong)(dong)保(bao)障部(bu)頒布《最(zui)(zui)低(di)工(gong)資(zi)(zi)(zi)規(gui)定》,明(ming)確(que)最(zui)(zui)低(di)工(gong)資(zi)(zi)(zi)標(biao)準每兩年至少調(diao)整一次。《國務(wu)院(yuan)批轉發(fa)改委(wei)等部(bu)門關于深化收入分配制(zhi)度改革(ge)的若干(gan)意見的通(tong)知》要求,根據經濟發(fa)展、物價(jia)變動(dong)(dong)等因素,適時調(diao)整最(zui)(zui)低(di)工(gong)資(zi)(zi)(zi)標(biao)準。
經福建省政府(fu)研究決定,從2017年7月1日起調(diao)整(zheng)全省最(zui)低工資(zi)標(biao)(biao)準(zhun)。調(diao)整(zheng)后的月最(zui)低工資(zi)標(biao)(biao)準(zhun)和小(xiao)時(shi)(shi)最(zui)低工資(zi)標(biao)(biao)準(zhun)均(jun)分為五檔。其(qi)中,廈門(men)市(shi)(思明(ming)區、湖里區、海滄(cang)區、集美區、同安區、翔安區)月最(zui)低工資(zi)標(biao)(biao)準(zhun)為1700元、小(xiao)時(shi)(shi)最(zui)低工資(zi)標(biao)(biao)準(zhun)為18元。
月最低(di)(di)(di)工(gong)資(zi)(zi)標準(zhun)適用(yong)于(yu)全日(ri)制就業(ye)勞(lao)動者(zhe),小(xiao)時最低(di)(di)(di)工(gong)資(zi)(zi)標準(zhun)適用(yong)于(yu)非全日(ri)制就業(ye)勞(lao)動者(zhe)。對從(cong)(cong)事公(gong)益(yi)性(xing)崗位工(gong)作的(de),因調(diao)整最低(di)(di)(di)工(gong)資(zi)(zi)標準(zhun)所增(zeng)加的(de)資(zi)(zi)金可繼續從(cong)(cong)就業(ye)資(zi)(zi)金中列支(zhi)。本次調(diao)整后的(de)最低(di)(di)(di)工(gong)資(zi)(zi)標準(zhun)從(cong)(cong)2017年7月1日(ri)起執行。
最低工資標準計算方法
最低(di)工(gong)(gong)(gong)資(zi)(zi)標準是(shi)指勞(lao)(lao)(lao)(lao)動(dong)者在法定工(gong)(gong)(gong)作時(shi)間(jian)內或依法簽訂的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)合同約定的(de)(de)工(gong)(gong)(gong)作時(shi)間(jian)內提供了(le)正(zheng)常(chang)勞(lao)(lao)(lao)(lao)動(dong)的(de)(de)前提下(xia),用(yong)人單位依法應(ying)當支付的(de)(de)最低(di)勞(lao)(lao)(lao)(lao)動(dong)報酬。其組成不(bu)包含以下(xia)項目:一是(shi)延長工(gong)(gong)(gong)作時(shi)間(jian)工(gong)(gong)(gong)資(zi)(zi);二是(shi)勞(lao)(lao)(lao)(lao)動(dong)者在中(zhong)班(ban)、夜班(ban)、高溫、低(di)溫、井下(xia)、有毒(du)有害等特殊(shu)工(gong)(gong)(gong)作環(huan)境、條件下(xia)的(de)(de)津(jin)貼;三是(shi)法律、法規(gui)和國(guo)家規(gui)定的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)者福(fu)利待(dai)遇等。
最(zui)(zui)低(di)(di)工(gong)資標準(zhun)是按照原勞動保障部《最(zui)(zui)低(di)(di)工(gong)資規定》要(yao)求(qiu),采取比重法(即月最(zui)(zui)低(di)(di)工(gong)資標準(zhun)=最(zui)(zui)低(di)(di)人均收入(ru)戶月生活費支出水平×每一就業者(zhe)的(de)贍養(yang)系(xi)數(shu)+調(diao)整數(shu),其(qi)中調(diao)整數(shu)主要(yao)考慮個人繳納的(de)養(yang)老、失業、醫(yi)療保險和(he)(he)住房公積金的(de)最(zui)(zui)低(di)(di)費用)進行(xing)測(ce)算,并綜合考慮GDP、在崗職工(gong)平均工(gong)資增(zeng)長、居民消費價格指(zhi)數(shu)和(he)(he)周邊省(sheng)市(shi)最(zui)(zui)低(di)(di)工(gong)資標準(zhun),以及企業承受能力等方面的(de)因素(su)進行(xing)調(diao)整修(xiu)正后(hou)得出。
最低工資標準調整情況
此次調(diao)(diao)整后,月最低(di)工資標準設五(wu)個(ge)(ge)檔(dang)位(wei),分別(bie)為1700元(yuan)、1650元(yuan)、1500元(yuan)、1380元(yuan)、1280元(yuan),其(qi)中(zhong):執行(xing)第(di)(di)(di)一檔(dang)有(you)6個(ge)(ge)區,執行(xing)第(di)(di)(di)二檔(dang)有(you)13個(ge)(ge)縣(xian)(xian)(市、區),執行(xing)第(di)(di)(di)三檔(dang)有(you)22個(ge)(ge)縣(xian)(xian)(市、區),執行(xing)第(di)(di)(di)四檔(dang)有(you)23個(ge)(ge)縣(xian)(xian),執行(xing)第(di)(di)(di)五(wu)檔(dang)有(you)20個(ge)(ge)縣(xian)(xian)。與(yu)調(diao)(diao)整前(qian)相比,扣除物價影響后平(ping)均(jun)增(zeng)幅(fu)為12%,年均(jun)增(zeng)幅(fu)6%。
非全日(ri)制(zhi)用工小時最低工資標(biao)準也(ye)相應設(she)五個檔,分別為(wei):18元、17.5元、16元、14.6元、13.6元,與(yu)調整(zheng)前相比,扣(kou)除物價影(ying)響后,平均增幅為(wei)12.2%,年均增幅6.1%。
