一、生育津貼什么時候申請
對于職工(gong)來講(jiang),生(sheng)(sheng)育津貼會(hui)在產假期間由用(yong)人單(dan)(dan)位(wei)支付(fu)而無(wu)需申(shen)請,對于用(yong)人單(dan)(dan)位(wei)來說,可以從生(sheng)(sheng)育次月起(qi)一年內申(shen)請撥(bo)付(fu)生(sheng)(sheng)育津貼。
職(zhi)工(gong)按(an)(an)照(zhao)規定(ding)享受產假(jia)或者計劃生育(yu)手術休假(jia)期間,生育(yu)津貼(tie)由用人單(dan)位按(an)(an)照(zhao)職(zhi)工(gong)原工(gong)資(zi)標準(zhun)逐(zhu)月(yue)墊付,再由社會保(bao)險經辦(ban)機構按(an)(an)照(zhao)規定(ding)撥付給(gei)用人單(dan)位。
職(zhi)工累計(ji)參加生(sheng)育(yu)保險(xian)滿1年,并且用(yong)人單(dan)位已(yi)向其墊付(fu)生(sheng)育(yu)津貼的(de)(de),用(yong)人單(dan)位可在職(zhi)工生(sheng)育(yu)或(huo)施行計(ji)劃(hua)生(sheng)育(yu)手術的(de)(de)次月起1年內,向統籌(chou)地區社會保險(xian)經辦機構申請撥付(fu)生(sheng)育(yu)津貼。申請撥付(fu)應當提(ti)供享受生(sheng)育(yu)保險(xian)待遇(yu)申請表、享受待遇(yu)人員的(de)(de)身(shen)份證明(ming)、嬰兒(er)出(chu)生(sheng)證明(ming)等材料。
二、生育津貼怎么算
根據國(guo)務院2012年頒布(bu)實施的(de)《女職工勞(lao)動保護(hu)特別規(gui)定(ding)》規(gui)定(ding):
女(nv)職(zhi)工(gong)(gong)(gong)(gong)產(chan)假期間的生(sheng)育(yu)(yu)津貼,對已(yi)經(jing)參加生(sheng)育(yu)(yu)保(bao)(bao)險(xian)的,按照用人(ren)單(dan)(dan)位上(shang)(shang)年度(du)職(zhi)工(gong)(gong)(gong)(gong)月平均工(gong)(gong)(gong)(gong)資(zi)的標(biao)準(zhun)(zhun)由生(sheng)育(yu)(yu)保(bao)(bao)險(xian)基金支付;對未(wei)參加生(sheng)育(yu)(yu)保(bao)(bao)險(xian)的,按照女(nv)職(zhi)工(gong)(gong)(gong)(gong)產(chan)假前(qian)工(gong)(gong)(gong)(gong)資(zi)的標(biao)準(zhun)(zhun)由用人(ren)單(dan)(dan)位支付。其計算公式如下:生(sheng)育(yu)(yu)津貼二上(shang)(shang)年度(du)職(zhi)工(gong)(gong)(gong)(gong)月平均工(gong)(gong)(gong)(gong)資(zi)或產(chan)假前(qian)工(gong)(gong)(gong)(gong)資(zi)/30天(tian)產(chan)假天(tian)數。
三、生育津貼報銷流程
1、用人單位需要提交的申報材料:
①社會保(bao)險(xian)登記表(biao);
②參加基(ji)本養老、工(gong)傷和生育保險人員增減表(biao);
③企業職工基本養(yang)老、工傷和生育保險申報匯(hui)總表(biao)。
2、生育女職工需要提交的申報材料:
①計(ji)劃生(sheng)育(yu)部門簽發的計(ji)劃生(sheng)育(yu)證(zheng)明(原件及復印件);
②醫療部門出具的嬰(ying)兒出生(死亡)證(zheng)明(原(yuan)件(jian)及復印件(jian));
③生育女職工、計劃生育手術職工本人身份證(原件(jian)及復印(yin)件(jian));
④企業職(zhi)工生育(yu)醫療證審領(ling)表;
⑤企業職(zhi)工計(ji)劃生育手術醫(yi)療證申(shen)領表;
⑥企業職工(gong)生育醫藥費報銷申請單;
⑦企業(ye)職工生育保險待遇(yu)核準結(jie)算表;
⑧企業職工生育保險(xian)外(wai)地就醫申請表(biao);
⑨生育醫療費(fei)用票據、費(fei)用清(qing)單、門診病歷(li)、出院小結(jie)等原(yuan)始資料;
⑩收款收據。
3、配偶生育的男職工需要提交的材料:
①計(ji)劃生育部門簽(qian)發的計(ji)劃生育證(zheng)明(原件及復印件);
②醫療部(bu)門出具(ju)的嬰兒出生(死(si)亡)證明(原(yuan)件及復(fu)印件);
③男(nan)職(zhi)工本人身份(fen)證(原(yuan)件及(ji)復印(yin)件);
生(sheng)育醫療(liao)費,應當在女職工(gong)妊娠至生(sheng)育或者終止妊娠前申(shen)辦;
生育津貼、一次性分娩營養補助費和異(yi)地(di)就醫的生育醫療費,應當在女職(zhi)工生育或者終止妊娠后1年內(nei)申辦;
計劃生(sheng)育手術費用,應當在手術前申(shen)辦;
男(nan)職工假期津貼(tie),應(ying)當在(zai)其配偶生育(yu)后1年內申辦。
逾期申辦的,社會保(bao)險經(jing)辦機構(gou)不予(yu)受理。
用人單(dan)位未按規(gui)定(ding)期限到當地(di)社會保(bao)險經辦(ban)機(ji)構為(wei)其(qi)參保(bao)職(zhi)工(gong)(gong)申辦(ban)生育(yu)保(bao)險待(dai)遇(yu)的(de)(de),該職(zhi)工(gong)(gong)的(de)(de)生育(yu)保(bao)險待(dai)遇(yu)由用人單(dan)位按照所在(zai)統籌地(di)區的(de)(de)待(dai)遇(yu)項目和標(biao)準(zhun)支付。
