勞動合同到期了怎么辦
1、合同解除
合(he)(he)同(tong)(tong)當(dang)事(shi)(shi)人(ren)約(yue)定的合(he)(he)同(tong)(tong)期(qi)限屆滿,因為(wei)合(he)(he)同(tong)(tong)目的已經達成或者(zhe)合(he)(he)同(tong)(tong)當(dang)事(shi)(shi)人(ren)認為(wei)合(he)(he)同(tong)(tong)期(qi)間的合(he)(he)作并(bing)不是滿意等原(yuan)因,選(xuan)擇(ze)解(jie)除合(he)(he)同(tong)(tong),使得合(he)(he)同(tong)(tong)終止。當(dang)然(ran),合(he)(he)同(tong)(tong)當(dang)事(shi)(shi)人(ren)之間的合(he)(he)同(tong)(tong)權利義務也隨(sui)之終止。
2、合同續訂

合同到期不續簽公司要賠償嗎
勞動(dong)(dong)合(he)同(tong)(tong)到期(qi)(qi)后(hou)用人單位(wei)不愿意(yi)續簽的,應(ying)當向勞動(dong)(dong)者(zhe)(zhe)支付經濟(ji)補償金,其法(fa)律依據是:《勞動(dong)(dong)合(he)同(tong)(tong)法(fa)》的第(di)46條(tiao):除用人單位(wei)維持或者(zhe)(zhe)提高勞動(dong)(dong)合(he)同(tong)(tong)約定條(tiao)件續訂(ding)勞動(dong)(dong)合(he)同(tong)(tong),勞動(dong)(dong)者(zhe)(zhe)不同(tong)(tong)意(yi)續訂(ding)的情形外,依照本(ben)法(fa)第(di)44條(tiao)第(di)1項(xiang)規定終(zhong)止(zhi)固(gu)定期(qi)(qi)限(xian)勞動(dong)(dong)合(he)同(tong)(tong)的,用人單位(wei)應(ying)當向勞動(dong)(dong)者(zhe)(zhe)支付經濟(ji)補償。
勞動合同到期不續簽的賠償規定
公司維持或者(zhe)提高勞(lao)(lao)動(dong)合同(tong)約定條件(工資待(dai)遇等(deng))續訂(ding)(ding)勞(lao)(lao)動(dong)合同(tong),勞(lao)(lao)動(dong)者(zhe)不同(tong)意(yi)續訂(ding)(ding),終止勞(lao)(lao)動(dong)合同(tong)的,沒有經(jing)濟補償。
公司(si)降低(di)勞(lao)動(dong)合(he)同約定條件(jian)(工資待遇等)續(xu)訂勞(lao)動(dong)合(he)同,勞(lao)動(dong)者不(bu)同意續(xu)訂,終止勞(lao)動(dong)合(he)同的,有經濟補償。
公司和勞(lao)動者一(yi)方或(huo)者雙方不予續(xu)訂勞(lao)動合(he)(he)同(tong),終止勞(lao)動合(he)(he)同(tong)的,有(you)經(jing)濟補(bu)償(chang)。
經濟補(bu)償按(an)勞(lao)(lao)動者(zhe)在本單位工作的年限,每滿一年支(zhi)付一個(ge)月工資(zi)的標(biao)準向(xiang)勞(lao)(lao)動者(zhe)支(zhi)付。六(liu)個(ge)月以上不滿一年的,按(an)一年計算(suan);不滿六(liu)個(ge)月的,向(xiang)勞(lao)(lao)動者(zhe)支(zhi)付半個(ge)月工資(zi)的經濟補(bu)償。
勞動(dong)者月(yue)工(gong)(gong)資(zi)(zi)高(gao)于用人(ren)單位所在直(zhi)轄市、設(she)區(qu)的(de)市級人(ren)民政府(fu)公布的(de)本地區(qu)上年(nian)度職工(gong)(gong)月(yue)平均工(gong)(gong)資(zi)(zi)三倍(bei)的(de),向(xiang)其支(zhi)付經濟(ji)補償(chang)(chang)的(de)標準按職工(gong)(gong)月(yue)平均工(gong)(gong)資(zi)(zi)三倍(bei)的(de)數額(e)支(zhi)付,向(xiang)其支(zhi)付經濟(ji)補償(chang)(chang)的(de)年(nian)限最高(gao)不超過十二年(nian)。
本條所稱月(yue)工資是指勞動者在勞動合同解(jie)除或者終(zhong)止前十二(er)個月(yue)的平均工資。
勞動合同到期怎么續簽
續訂勞動合同,如原勞動合同的主要條款已有較大改變,雙方應重新協商簽訂新的勞動合同。如原勞動合同的條款變動不大,雙方可以簽訂《延續勞動合同協議書》,并明確勞動合同延續的期限及其他需重新確定的合同條款;續訂勞動合同后,用人單位應將雙方(fang)重新簽(qian)訂的(de)勞(lao)動(dong)合(he)同(tong)或《延續(xu)勞(lao)動(dong)合(he)同(tong)協(xie)議書(shu)》(附原勞(lao)動(dong)合(he)同(tong))一式兩(liang)份,送有管轄權的(de)勞(lao)動(dong)鑒(jian)證機構進行鑒(jian)證,并到社會保(bao)險經(jing)辦(ban)機構辦(ban)理社會保(bao)險延續(xu)手續(xu)。
不簽勞動合同如何賠償
公司沒簽(qian)勞動(dong)合(he)同,需要向未(wei)簽(qian)勞動(dong)合(he)同的(de)(de)勞動(dong)者支(zhi)付雙(shuang)倍工(gong)(gong)資(zi)(zi)的(de)(de)賠償。經濟(ji)補償按(an)勞動(dong)者在本單(dan)位工(gong)(gong)作年(nian)限(xian)每滿(man)一年(nian)一個(ge)月的(de)(de)工(gong)(gong)資(zi)(zi)標準支(zhi)付。六(liu)個(ge)月以上不滿(man)一年(nian)的(de)(de),按(an)一年(nian)計算;六(liu)個(ge)月以下的(de)(de),給予勞動(dong)者半個(ge)月工(gong)(gong)資(zi)(zi)的(de)(de)經濟(ji)補償。具體標準如下:
1、工(gong)作(zuo)年(nian)(nian)限(xian)計(ji)算(suan)(suan)標準:根據勞動者在本單位工(gong)作(zuo)年(nian)(nian)限(xian),每滿一年(nian)(nian)支付(fu)一個(ge)月(yue)(yue)工(gong)資的(de)(de)標準,超(chao)過六個(ge)月(yue)(yue)不(bu)滿一年(nian)(nian)的(de)(de),按(an)一年(nian)(nian)計(ji)算(suan)(suan);不(bu)足六個(ge)月(yue)(yue)的(de)(de),按(an)支付(fu)半個(ge)月(yue)(yue)工(gong)資的(de)(de)經濟補償(chang)金計(ji)算(suan)(suan);
2、不再限(xian)定賠償期限(xian)(12年);
3、工(gong)資計算基(ji)數:指(zhi)勞動者在勞動合同終止前12個月(yue)的平均工(gong)資。這里的工(gong)資是指(zhi)應付(fu)給勞動者的工(gong)資,一般包括:計時工(gong)資、計件工(gong)資、獎(jiang)金、津(jin)貼和補(bu)貼、加(jia)班(ban)工(gong)資、特殊(shu)情況(kuang)下支付(fu)的工(gong)資。
