《勞(lao)動(dong)法》第(di)48條規(gui)定,國家實行最(zui)低工(gong)資保(bao)障(zhang)(zhang)制(zhi)度(du),最(zui)低工(gong)資的具(ju)體標(biao)(biao)準(zhun)由省、自治區、直轄市人民政(zheng)府規(gui)定。原勞(lao)動(dong)保(bao)障(zhang)(zhang)部頒布《最(zui)低工(gong)資規(gui)定》,明(ming)確最(zui)低工(gong)資標(biao)(biao)準(zhun)每兩年至少(shao)調(diao)整一次。《國務(wu)院(yuan)批轉發改(gai)(gai)委等(deng)部門關于(yu)深化收入分(fen)配制(zhi)度(du)改(gai)(gai)革的若干意見的通(tong)知》要求,根據經濟發展、物價變動(dong)等(deng)因素,適時調(diao)整最(zui)低工(gong)資標(biao)(biao)準(zhun)。
廣東(dong)(dong)(dong)省(sheng)(sheng)人(ren)民(min)政(zheng)府發布《廣東(dong)(dong)(dong)省(sheng)(sheng)人(ren)民(min)政(zheng)府關于調(diao)整(zheng)(zheng)我省(sheng)(sheng)企(qi)業職工(gong)(gong)(gong)最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標(biao)準的通(tong)知》(以(yi)下簡稱“通(tong)知”),從2021年12月(yue)1日(ri)起,對廣東(dong)(dong)(dong)省(sheng)(sheng)企(qi)業職工(gong)(gong)(gong)最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標(biao)準和(he)非(fei)全(quan)日(ri)制職工(gong)(gong)(gong)小時最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標(biao)準進行(xing)調(diao)整(zheng)(zheng)。其中,廣州最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標(biao)準調(diao)整(zheng)(zheng)為2300元/月(yue),非(fei)全(quan)日(ri)制職工(gong)(gong)(gong)小時最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標(biao)準調(diao)整(zheng)(zheng)為22.2元/小時。
最低工資標準計算方法
最(zui)低工資(zi)標準是(shi)指勞(lao)動(dong)(dong)者(zhe)(zhe)在(zai)法定工作時間內或依(yi)法簽訂的(de)(de)(de)勞(lao)動(dong)(dong)合(he)同約定的(de)(de)(de)工作時間內提(ti)供了正常(chang)勞(lao)動(dong)(dong)的(de)(de)(de)前提(ti)下(xia),用人單位依(yi)法應(ying)當支付的(de)(de)(de)最(zui)低勞(lao)動(dong)(dong)報酬。其組成(cheng)不包(bao)含以下(xia)項目:一(yi)是(shi)延(yan)長工作時間工資(zi);二是(shi)勞(lao)動(dong)(dong)者(zhe)(zhe)在(zai)中班、夜(ye)班、高(gao)溫、低溫、井(jing)下(xia)、有(you)毒有(you)害(hai)等特殊工作環境、條件下(xia)的(de)(de)(de)津貼;三是(shi)法律(lv)、法規(gui)和(he)國家規(gui)定的(de)(de)(de)勞(lao)動(dong)(dong)者(zhe)(zhe)福利待遇等。
最(zui)低(di)工(gong)(gong)資(zi)標準是按照原勞動保障部(bu)《最(zui)低(di)工(gong)(gong)資(zi)規定》要求,采取比(bi)重法(即月(yue)最(zui)低(di)工(gong)(gong)資(zi)標準=最(zui)低(di)人均(jun)收入戶月(yue)生活費支出水平(ping)×每一就業者的(de)贍養系數(shu)(shu)+調整數(shu)(shu),其(qi)中(zhong)調整數(shu)(shu)主要考慮個人繳納的(de)養老、失業、醫療保險和住房公(gong)積金的(de)最(zui)低(di)費用(yong))進行測算,并綜合考慮GDP、在崗職工(gong)(gong)平(ping)均(jun)工(gong)(gong)資(zi)增長、居民(min)消費價(jia)格(ge)指數(shu)(shu)和周邊省市最(zui)低(di)工(gong)(gong)資(zi)標準,以及(ji)企業承受能(neng)力等方面的(de)因素進行調整修(xiu)正后得出。
廣東省企業職工最低工資標準分類
一、廣東省一類地區(廣州、深圳)
非全日制職(zhi)工小時(shi)最(zui)低工資(zi)標準為22.2元/小時(shi)。
廣州全日制月最低工資(zi)標(biao)準為(wei)2300元/月。
深圳全日制月(yue)最低工(gong)資標準為2360元/月(yue)。
二、廣東省二類地區(珠海、佛山、東莞、中山)
非(fei)全日制職工(gong)小時最低工(gong)資(zi)標準為18.1元/小時。
全日制月最(zui)低工資標準為1900元/月。
三、廣東省三類地區(汕頭、惠州、江門、肇慶、湛江)
非全日(ri)制職(zhi)工(gong)小(xiao)時最低工(gong)資標準為17元(yuan)/小(xiao)時。
全(quan)日制月(yue)(yue)最低工資標準為1720元(yuan)/月(yue)(yue)。
四、廣東省四類地區(韶關、河源、梅州、汕尾、陽江、茂名、清遠、潮州、揭陽、云浮)
非全日制(zhi)職工小時(shi)最(zui)低工資標準為16.1元(yuan)/小時(shi)。
全日(ri)制月最低(di)工資標(biao)準為1620元/月。
