為提高低(di)收入(ru)勞動者收入(ru)水平,充分(fen)發揮最(zui)低(di)工(gong)資(zi)(zi)的(de)保障(zhang)作用(yong),根(gen)據《廣(guang)(guang)(guang)東省(sheng)工(gong)資(zi)(zi)支付條例(li)》、《廣(guang)(guang)(guang)東省(sheng)人民政府(fu)關于(yu)調(diao)整廣(guang)(guang)(guang)東省(sheng)最(zui)低(di)工(gong)資(zi)(zi)標準的(de)通知(zhi)》,廣(guang)(guang)(guang)州市(shi)人力資(zi)(zi)源(yuan)和社會保障(zhang)局發布了《關于(yu)調(diao)整廣(guang)(guang)(guang)州市(shi)最(zui)低(di)工(gong)資(zi)(zi)標準的(de)通知(zhi)》。有(you)關事項通知(zhi)如下(xia):
一、從2021年12月1日起,廣州市(shi)全日制就(jiu)業(ye)勞(lao)動者(zhe)最低工資(zi)標準調(diao)整為(wei)2300元/月,非全日制就(jiu)業(ye)勞(lao)動者(zhe)最低工資(zi)標準調(diao)整為(wei)22.2元/小(xiao)時。
二、在勞動者提供正常(chang)勞動的情況下,用人單(dan)位應(ying)支付給勞動者的工(gong)資在剔除下列各項(xiang)以后,不得低于(yu)當地最低工(gong)資標準:
(一)延長工(gong)(gong)作(zuo)時間工(gong)(gong)資;
(二)中班、夜班、高溫(wen)、低(di)溫(wen)、井下(xia)、有(you)毒(du)有(you)害等特殊工作環(huan)境、條件下(xia)的津貼;
(三)法律、法規和(he)國(guo)家規定的勞動者福利待(dai)遇等。
三、實行計(ji)件工(gong)(gong)資形式的(de)用人單位,在(zai)科學合理確定(ding)(ding)勞動(dong)定(ding)(ding)額(e)和(he)計(ji)件單價的(de)基礎上(shang),勞動(dong)者在(zai)法(fa)定(ding)(ding)工(gong)(gong)作時(shi)間(jian)內(nei)提供正(zheng)常(chang)勞動(dong)的(de)前提下,支付勞動(dong)者的(de)工(gong)(gong)資不得低于當地(di)最低工(gong)(gong)資標準。
四、健全最(zui)低(di)工(gong)(gong)資和(he)支(zhi)付保障制(zhi)(zhi)度,推動(dong)將不完全符合確立勞(lao)(lao)(lao)動(dong)關系情形(xing)的新就業形(xing)態勞(lao)(lao)(lao)動(dong)者(zhe)納入制(zhi)(zhi)度保障范圍。督(du)促企業向提(ti)供正常勞(lao)(lao)(lao)動(dong)的勞(lao)(lao)(lao)動(dong)者(zhe)支(zhi)付不低(di)于當地最(zui)低(di)工(gong)(gong)資標(biao)準(zhun)的勞(lao)(lao)(lao)動(dong)報酬(chou),按時足(zu)額支(zhi)付,不得克(ke)扣或(huo)者(zhe)無(wu)故拖欠。
五、各區、各單位要嚴格執(zhi)行(xing)最(zui)(zui)低(di)工(gong)資保障制度。做好(hao)宣傳解讀,對(dui)于推動將不(bu)完全符合確立勞動關系情(qing)形(xing)的(de)新就業形(xing)態勞動者納入最(zui)(zui)低(di)工(gong)資制度保障范(fan)圍等(deng)(deng)新要求,要切實(shi)加大宣傳引導力度。加強檢查監(jian)督,暢通(tong)舉報投(tou)訴(su)渠道,密切關注(zhu)新就業形(xing)態領(ling)域落實(shi)情(qing)況,對(dui)違反最(zui)(zui)低(di)工(gong)資規定、超(chao)時加班(ban)等(deng)(deng)違法行(xing)為依(yi)法嚴肅查處,確保最(zui)(zui)低(di)工(gong)資標準落到實(shi)處,切實(shi)維護勞動者的(de)合法權益。
