一、民事(shi)信托和(he)商事(shi)信托

按(an)照信(xin)(xin)(xin)托(tuo)的(de)目的(de)劃分，信(xin)(xin)(xin)托(tuo)可分為(wei)(wei)民事(shi)信(xin)(xin)(xin)托(tuo)和商事(shi)信(xin)(xin)(xin)托(tuo)。凡是以(yi)民法為(wei)(wei)依據(ju)建(jian)立(li)的(de)信(xin)(xin)(xin)托(tuo)稱為(wei)(wei)民事(shi)信(xin)(xin)(xin)托(tuo)，即民事(shi)信(xin)(xin)(xin)托(tuo)是屬(shu)(shu)于民法范圍內的(de)信(xin)(xin)(xin)托(tuo)；商事(shi)信(xin)(xin)(xin)托(tuo)是“民事(shi)信(xin)(xin)(xin)托(tuo)”的(de)對稱，是以(yi)商法為(wei)(wei)依據(ju)建(jian)立(li)的(de)信(xin)(xin)(xin)托(tuo)，屬(shu)(shu)于商法范圍內的(de)信(xin)(xin)(xin)托(tuo)業務。

二、資金信托(tuo)和財產信托(tuo)

資(zi)金信(xin)托(tuo)(tuo)(tuo)(tuo)，是(shi)指委托(tuo)(tuo)(tuo)(tuo)人(ren)基于(yu)對信(xin)托(tuo)(tuo)(tuo)(tuo)投(tou)資(zi)公司的(de)(de)(de)(de)信(xin)任，將自己(ji)合法擁(yong)有的(de)(de)(de)(de)資(zi)金委托(tuo)(tuo)(tuo)(tuo)給(gei)信(xin)托(tuo)(tuo)(tuo)(tuo)投(tou)資(zi)公司，由(you)信(xin)托(tuo)(tuo)(tuo)(tuo)投(tou)資(zi)公司按委托(tuo)(tuo)(tuo)(tuo)人(ren)的(de)(de)(de)(de)意愿以(yi)(yi)自己(ji)的(de)(de)(de)(de)名義，為受(shou)益人(ren)的(de)(de)(de)(de)利益或特定(ding)目(mu)的(de)(de)(de)(de)管(guan)理、運用和處(chu)分資(zi)金的(de)(de)(de)(de)行為；財產(chan)信(xin)托(tuo)(tuo)(tuo)(tuo)是(shi)指委托(tuo)(tuo)(tuo)(tuo)人(ren)將自己(ji)的(de)(de)(de)(de)動(dong)產(chan)、不(bu)動(dong)產(chan)以(yi)(yi)及版權、知識產(chan)權等非(fei)貨幣(bi)形式的(de)(de)(de)(de)財產(chan)、財產(chan)權，委托(tuo)(tuo)(tuo)(tuo)給(gei)信(xin)托(tuo)(tuo)(tuo)(tuo)投(tou)資(zi)公司按照約定(ding)的(de)(de)(de)(de)條(tiao)件和目(mu)的(de)(de)(de)(de)進行管(guan)理或者處(chu)分的(de)(de)(de)(de)行為。

三、個人(ren)(ren)信托(tuo)(tuo)和(he)法人(ren)(ren)信托(tuo)(tuo)

個(ge)人(ren)信(xin)托是以個(ge)人(ren)為服務(wu)對象(xiang)的信(xin)托業務(wu)，其委托者(zhe)是個(ge)人(ren)，受益者(zhe)也是個(ge)人(ren)。法人(ren)信(xin)托包括(kuo)營利法人(ren)團(tuan)體和公益法人(ren)團(tuan)體，凡以一個(ge)組織(zhi)體為委托人(ren)的都是法人(ren)信(xin)托。

四、私(si)益信(xin)托和公(gong)益信(xin)托

委托(tuo)(tuo)人為(wei)(wei)自己、親屬(shu)、朋友或(huo)者其(qi)他(ta)特(te)定個(ge)人的(de)利益(yi)而設(she)立的(de)信(xin)(xin)托(tuo)(tuo)是(shi)(shi)私益(yi)信(xin)(xin)托(tuo)(tuo)。私益(yi)信(xin)(xin)托(tuo)(tuo)可(ke)以(yi)是(shi)(shi)自益(yi)信(xin)(xin)托(tuo)(tuo)，也可(ke)以(yi)是(shi)(shi)他(ta)益(yi)信(xin)(xin)托(tuo)(tuo)。委托(tuo)(tuo)人為(wei)(wei)了社(she)會(hui)公(gong)(gong)眾利益(yi)而設(she)立的(de)信(xin)(xin)托(tuo)(tuo)是(shi)(shi)公(gong)(gong)益(yi)信(xin)(xin)托(tuo)(tuo)，公(gong)(gong)益(yi)信(xin)(xin)托(tuo)(tuo)只能是(shi)(shi)他(ta)益(yi)信(xin)(xin)托(tuo)(tuo)。
