2023年2月4日,中國(guo)貴州茅臺酒廠(集(ji)團)有(you)限責(ze)任公(gong)(gong)(gong)(gong)司(si)新增一則開庭公(gong)(gong)(gong)(gong)告(gao),被告(gao)之一為(wei)上(shang)海(hai)尋夢(meng)信息技(ji)術有(you)限公(gong)(gong)(gong)(gong)司(si),即大眾熟知的電商(shang)品牌拼多(duo)多(duo)所屬公(gong)(gong)(gong)(gong)司(si);以及貴州國(guo)登酒業股份(fen)有(you)限公(gong)(gong)(gong)(gong)司(si)、貴州省(sheng)仁懷市茅臺鎮私(si)房酒業有(you)限公(gong)(gong)(gong)(gong)司(si)兩家酒廠公(gong)(gong)(gong)(gong)司(si)。案由為(wei)侵(qin)害商(shang)標權糾紛,并定(ding)于(yu)2月20日在上(shang)海(hai)市徐(xu)匯區(qu)人民法院開庭審理。
據了解,此次訴訟指向并非假冒茅臺旗下的明星產品,而是一款不知名的 " 季老名酒 "。此案系茅臺集團與茅臺鎮兩家生產商被告的商標權糾紛,主訴兩酒廠擅自使用“季老”標識,讓公眾誤認為該白酒產品與貴州茅臺酒廠名譽董事長季克良甚至茅臺集團有合作關系或其他關聯關系,進而造成混淆誤認。對于電商平臺,茅(mao)臺集團(tuan)的訴訟請求為斷開侵(qin)權(quan)商品(pin)鏈接(jie)。
