需要住房(fang)貸款還請,無抵押(ya),有(you)房(fang)產證(zheng),契稅證(zheng),土地證(zheng),由你說的(de)子女(nv)和(he)父母一起持(chi)有(you)各(ge)自(zi)身份證(zheng),戶口(kou)本,婚姻情況證(zheng)明,以上(shang)住房(fang)三(san)證(zheng),一起到住房(fang)所屬房(fang)管部門,和(he)買家(jia)簽署(shu)合同,辦理住房(fang)過戶。
《房屋(wu)登(deng)記(ji)辦(ban)法》:第十(shi)三(san)條共(gong)(gong)(gong)(gong)有(you)(you)(you)房屋(wu),應當(dang)由共(gong)(gong)(gong)(gong)有(you)(you)(you)人(ren)(ren)共(gong)(gong)(gong)(gong)同申(shen)請(qing)(qing)登(deng)記(ji)。共(gong)(gong)(gong)(gong)有(you)(you)(you)房屋(wu)所(suo)有(you)(you)(you)權變更登(deng)記(ji),可以由相(xiang)關的(de)共(gong)(gong)(gong)(gong)有(you)(you)(you)人(ren)(ren)申(shen)請(qing)(qing),但因共(gong)(gong)(gong)(gong)有(you)(you)(you)性質或者(zhe)共(gong)(gong)(gong)(gong)有(you)(you)(you)人(ren)(ren)份額變更申(shen)請(qing)(qing)房屋(wu)登(deng)記(ji)的(de),應當(dang)由共(gong)(gong)(gong)(gong)有(you)(you)(you)人(ren)(ren)共(gong)(gong)(gong)(gong)同申(shen)請(qing)(qing)。第三(san)十(shi)二條發生下(xia)列情形之一的(de),當(dang)事人(ren)(ren)應當(dang)在(zai)有(you)(you)(you)關法律文件生效或者(zhe)事實發生后申(shen)請(qing)(qing)房屋(wu)所(suo)有(you)(you)(you)權轉移登(deng)記(ji):
(一)買賣;
(二)互換;
(三)贈與;
(四)繼承、受遺贈(zeng);
(五)房屋分割、合并,導致所(suo)有權發生轉移的;
(六)以(yi)房屋出資入(ru)股;
(七)法(fa)人或者其他組織分立、合(he)并(bing),導致房(fang)屋所有(you)權發生轉(zhuan)移的;
(八)法律、法規(gui)規(gui)定的(de)其他情形。
第三十三條申請房屋所有權轉移登記,應當提交下列材料:
(一)登記申(shen)請(qing)書;
(二)申請人身(shen)份證明(ming);
(三)房屋所有權(quan)證書(shu)或者(zhe)房地產權(quan)證書(shu);
(四)證明房(fang)屋所有權(quan)發生轉移的材(cai)料;
(五(wu))其(qi)他必要(yao)材(cai)料。前款第(四)項(xiang)材(cai)料,可以是買賣合(he)同、互換(huan)合(he)同、贈(zeng)與合(he)同、受遺贈(zeng)證(zheng)明(ming)、繼承證(zheng)明(ming)、分割協(xie)議、合(he)并協(xie)議、人民法(fa)院或者(zhe)(zhe)仲裁委員會生(sheng)效的法(fa)律文書,或者(zhe)(zhe)其(qi)他證(zheng)明(ming)房屋所(suo)有權發生(sheng)轉移的材(cai)料。
