《勞(lao)動法(fa)》第48條規定(ding),國家實(shi)行最(zui)低工(gong)(gong)資(zi)保障制度,最(zui)低工(gong)(gong)資(zi)的具(ju)體標(biao)準(zhun)由(you)省、自治區(qu)、直轄市人民政府規定(ding)。原(yuan)勞(lao)動保障部頒(ban)布《最(zui)低工(gong)(gong)資(zi)規定(ding)》,明確最(zui)低工(gong)(gong)資(zi)標(biao)準(zhun)每兩年至少調整(zheng)一次(ci)。《國務院批轉發(fa)改委(wei)等部門關于深化收入分配制度改革的若干意見的通知》要求(qiu),根據經濟發(fa)展、物價變動等因素,適(shi)時調整(zheng)最(zui)低工(gong)(gong)資(zi)標(biao)準(zhun)。
2019山東最低工資標準
根(gen)據山(shan)東省人民政府《關于(yu)公布全省最低工(gong)資標準的通(tong)知》山(shan)東省決定從2018年6月1日(ri)起對全省各(ge)市(shi)最低工(gong)資標準調(diao)整如下:
一、調(diao)整后的全省月最低(di)工資標(biao)準為1910元、1730元、1550元;小時最低(di)工資標(biao)準為19.1元、17.3元、15.5元(各市最低(di)工資標(biao)準見附圖)。
二(er)、月最低(di)工資標(biao)準適用于(yu)全(quan)日(ri)制(zhi)就(jiu)業勞動(dong)者;小時最低(di)工資標(biao)準適用于(yu)非全(quan)日(ri)制(zhi)就(jiu)業勞動(dong)者。
三、各地要加強(qiang)對(dui)《最低(di)(di)工(gong)資(zi)(zi)規定(ding)》(原(yuan)勞(lao)(lao)動(dong)和社(she)會保障部令第21號(hao))和最低(di)(di)工(gong)資(zi)(zi)標準的宣傳,在當(dang)地主要媒體上公布(bu)最低(di)(di)工(gong)資(zi)(zi)標準,讓用人單位(wei)、勞(lao)(lao)動(dong)者和公眾(zhong)廣為(wei)了解。要進一步加強(qiang)對(dui)用人單位(wei)執(zhi)行最低(di)(di)工(gong)資(zi)(zi)標準情況的監(jian)督檢查(cha),依法查(cha)處(chu)違反《最低(di)(di)工(gong)資(zi)(zi)規定(ding)》的行為(wei),切(qie)實維護勞(lao)(lao)動(dong)者合法權益。
另:最低工資(zi)≠標準工資(zi)
值(zhi)得(de)(de)注意的(de)是(shi),最(zui)低工(gong)(gong)(gong)資(zi)標準不包含(han)延長(chang)工(gong)(gong)(gong)作時間工(gong)(gong)(gong)資(zi),中班、夜班、高溫、低溫、井下、有毒(du)有害等特殊工(gong)(gong)(gong)作環境(jing)、條件(jian)(jian)(jian)下的(de)津貼,以及法(fa)律、法(fa)規(gui)和國家規(gui)定(ding)的(de)勞(lao)(lao)(lao)動(dong)(dong)者福利(li)待遇等。對勞(lao)(lao)(lao)動(dong)(dong)者包吃住(zhu)屬(shu)于(yu)用人單(dan)位(wei)給予(yu)職(zhi)工(gong)(gong)(gong)的(de)福利(li),用人單(dan)位(wei)不能將此(ci)計(ji)(ji)(ji)算(suan)在工(gong)(gong)(gong)資(zi)之內(nei),更(geng)不能因此(ci)使(shi)支付的(de)貨(huo)幣工(gong)(gong)(gong)資(zi)低于(yu)最(zui)低工(gong)(gong)(gong)資(zi)標準。實(shi)行(xing)計(ji)(ji)(ji)件(jian)(jian)(jian)工(gong)(gong)(gong)資(zi)制的(de)用人單(dan)位(wei)必須(xu)科學(xue)合理制定(ding)勞(lao)(lao)(lao)動(dong)(dong)定(ding)額,確(que)定(ding)基本計(ji)(ji)(ji)件(jian)(jian)(jian)單(dan)價和超額計(ji)(ji)(ji)件(jian)(jian)(jian)單(dan)價,勞(lao)(lao)(lao)動(dong)(dong)者提供正常勞(lao)(lao)(lao)動(dong)(dong)并按基本計(ji)(ji)(ji)件(jian)(jian)(jian)單(dan)價計(ji)(ji)(ji)算(suan)的(de)工(gong)(gong)(gong)資(zi),不得(de)(de)低于(yu)最(zui)低工(gong)(gong)(gong)資(zi)標準。勞(lao)(lao)(lao)動(dong)(dong)者個人應當繳納的(de)社會保險費和住(zhu)房公積金包含(han)在最(zui)低工(gong)(gong)(gong)資(zi)標準之內(nei)。
山東2018年企業工資指導線
山東省人民政府還發布了2018年企業工資指導線,其中增長上線為11%、基準線為7%、下線為3%。這是山東連續9年調整最低(di)工(gong)資(zi)標(biao)準,連續20年發布企業工(gong)資(zi)指導(dao)線。
企(qi)業(ye)(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)指導線是企(qi)業(ye)(ye)(ye)(ye)與(yu)職工(gong)(gong)(gong)(gong)開展工(gong)(gong)(gong)(gong)資(zi)集體協商的重(zhong)要基礎。企(qi)業(ye)(ye)(ye)(ye)薪酬調查(cha)數(shu)據顯示,山東(dong)省企(qi)業(ye)(ye)(ye)(ye)人工(gong)(gong)(gong)(gong)成本(ben)在(zai)全國處于中(zhong)等偏下水(shui)平,2011—2016年(nian)山東(dong)省企(qi)業(ye)(ye)(ye)(ye)人工(gong)(gong)(gong)(gong)成本(ben)占(zhan)總(zong)成本(ben)比重(zhong)為12.25%,其中(zhong)勞動報酬占(zhan)總(zong)成本(ben)比重(zhong)為8.5%,社會保(bao)險費用占(zhan)總(zong)成本(ben)比重(zhong)為1.9%,企(qi)業(ye)(ye)(ye)(ye)職工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)仍(reng)有一定的增長空(kong)間。
