《勞(lao)動法(fa)》第(di)48條規定(ding),國家實行最(zui)(zui)低(di)工(gong)資保(bao)障(zhang)制(zhi)度(du),最(zui)(zui)低(di)工(gong)資的(de)(de)具體標準(zhun)由省、自(zi)治(zhi)區、直轄市人(ren)民政府規定(ding)。原勞(lao)動保(bao)障(zhang)部(bu)頒布《最(zui)(zui)低(di)工(gong)資規定(ding)》,明確最(zui)(zui)低(di)工(gong)資標準(zhun)每兩年至少調整(zheng)一次。《國務院批轉發(fa)改委等部(bu)門關(guan)于(yu)深化收入分(fen)配制(zhi)度(du)改革的(de)(de)若干意(yi)見(jian)的(de)(de)通知(zhi)》要求,根(gen)據經濟發(fa)展、物價(jia)變動等因素,適(shi)時調整(zheng)最(zui)(zui)低(di)工(gong)資標準(zhun)。
2019山東最低工資標準
根據山東(dong)省人民政府(fu)《關于公(gong)布全(quan)省最低工(gong)資標準的通知》山東(dong)省決定從(cong)2018年6月(yue)1日起(qi)對(dui)全(quan)省各(ge)市最低工(gong)資標準調(diao)整(zheng)如下:
一、調整后的全省月最(zui)(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun)為(wei)1910元(yuan)(yuan)(yuan)、1730元(yuan)(yuan)(yuan)、1550元(yuan)(yuan)(yuan);小時最(zui)(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun)為(wei)19.1元(yuan)(yuan)(yuan)、17.3元(yuan)(yuan)(yuan)、15.5元(yuan)(yuan)(yuan)(各市(shi)最(zui)(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun)見附圖)。
二、月最低工(gong)資(zi)標準(zhun)適用(yong)于全(quan)日(ri)制(zhi)就(jiu)業勞動者;小(xiao)時最低工(gong)資(zi)標準(zhun)適用(yong)于非全(quan)日(ri)制(zhi)就(jiu)業勞動者。
三、各地要(yao)加強對《最(zui)(zui)低工(gong)資(zi)規(gui)定(ding)》(原勞動(dong)和社會保(bao)障(zhang)部令第21號)和最(zui)(zui)低工(gong)資(zi)標準(zhun)(zhun)的(de)宣傳(chuan),在當(dang)地主(zhu)要(yao)媒體上公布最(zui)(zui)低工(gong)資(zi)標準(zhun)(zhun),讓用(yong)人單位(wei)、勞動(dong)者和公眾(zhong)廣為(wei)了解。要(yao)進一步加強對用(yong)人單位(wei)執行最(zui)(zui)低工(gong)資(zi)標準(zhun)(zhun)情況的(de)監督檢查(cha),依法查(cha)處違(wei)反《最(zui)(zui)低工(gong)資(zi)規(gui)定(ding)》的(de)行為(wei),切實維護(hu)勞動(dong)者合法權益(yi)。
另:最低(di)工(gong)資≠標準工(gong)資
值(zhi)得注意的(de)(de)是,最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標準(zhun)不(bu)包含(han)延長工(gong)(gong)(gong)作時間工(gong)(gong)(gong)資(zi)(zi),中班、夜(ye)班、高溫、低(di)(di)溫、井下(xia)、有(you)毒有(you)害等(deng)特殊工(gong)(gong)(gong)作環境、條件(jian)(jian)下(xia)的(de)(de)津貼,以及法律(lv)、法規(gui)和國家規(gui)定(ding)的(de)(de)勞(lao)動者(zhe)(zhe)(zhe)福利待遇等(deng)。對勞(lao)動者(zhe)(zhe)(zhe)包吃住屬于(yu)(yu)用(yong)人(ren)單(dan)位(wei)給予職(zhi)工(gong)(gong)(gong)的(de)(de)福利,用(yong)人(ren)單(dan)位(wei)不(bu)能將此計算在工(gong)(gong)(gong)資(zi)(zi)之(zhi)內(nei),更不(bu)能因此使支付(fu)的(de)(de)貨幣工(gong)(gong)(gong)資(zi)(zi)低(di)(di)于(yu)(yu)最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標準(zhun)。實行計件(jian)(jian)工(gong)(gong)(gong)資(zi)(zi)制(zhi)的(de)(de)用(yong)人(ren)單(dan)位(wei)必須科(ke)學合(he)理制(zhi)定(ding)勞(lao)動定(ding)額,確定(ding)基本計件(jian)(jian)單(dan)價(jia)和超(chao)額計件(jian)(jian)單(dan)價(jia),勞(lao)動者(zhe)(zhe)(zhe)提供正常勞(lao)動并(bing)按(an)基本計件(jian)(jian)單(dan)價(jia)計算的(de)(de)工(gong)(gong)(gong)資(zi)(zi),不(bu)得低(di)(di)于(yu)(yu)最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標準(zhun)。勞(lao)動者(zhe)(zhe)(zhe)個人(ren)應當繳納的(de)(de)社會保險(xian)費和住房公積(ji)金包含(han)在最(zui)(zui)低(di)(di)工(gong)(gong)(gong)資(zi)(zi)標準(zhun)之(zhi)內(nei)。
山東2018年企業工資指導線
山東省人民政府還發布了2018年企業工資指導線,其中增長上線為11%、基準線為7%、下線為3%。這是山(shan)東連續(xu)9年調整(zheng)最低(di)工資標準,連續(xu)20年發布企業工資指導線。
企(qi)業(ye)(ye)工(gong)資指導線是企(qi)業(ye)(ye)與職(zhi)工(gong)開(kai)展(zhan)工(gong)資集體協(xie)商的重(zhong)要(yao)基礎。企(qi)業(ye)(ye)薪酬調查數(shu)據顯示(shi),山(shan)東(dong)(dong)省企(qi)業(ye)(ye)人(ren)工(gong)成本(ben)(ben)在全國處于中等偏下水平,2011—2016年山(shan)東(dong)(dong)省企(qi)業(ye)(ye)人(ren)工(gong)成本(ben)(ben)占(zhan)總成本(ben)(ben)比重(zhong)為(wei)12.25%,其中勞動報(bao)酬占(zhan)總成本(ben)(ben)比重(zhong)為(wei)8.5%,社(she)會保險費用占(zhan)總成本(ben)(ben)比重(zhong)為(wei)1.9%,企(qi)業(ye)(ye)職(zhi)工(gong)工(gong)資仍有一(yi)定的增長空間。
