《勞(lao)動(dong)法》第(di)48條規定(ding)(ding),國家實(shi)行最(zui)低(di)工(gong)資保障制(zhi)度(du),最(zui)低(di)工(gong)資的(de)具體(ti)標準由省、自治區、直(zhi)轄市人民政府規定(ding)(ding)。原勞(lao)動(dong)保障部頒布《最(zui)低(di)工(gong)資規定(ding)(ding)》,明確最(zui)低(di)工(gong)資標準每兩年至少調(diao)整(zheng)一次(ci)。《國務院(yuan)批轉(zhuan)發改委等部門關于深化收入分配(pei)制(zhi)度(du)改革的(de)若干意(yi)見的(de)通知(zhi)》要求,根(gen)據(ju)經濟發展、物價變動(dong)等因素,適時調(diao)整(zheng)最(zui)低(di)工(gong)資標準。
2019山東最低工資標準
根據山東省人民(min)政府《關(guan)于(yu)公布全省最(zui)低(di)工資標(biao)準(zhun)的(de)通(tong)知(zhi)》山東省決定從2018年6月1日起對全省各市(shi)最(zui)低(di)工資標(biao)準(zhun)調(diao)整如下:
一、調整后的全(quan)省(sheng)月(yue)最低(di)(di)工(gong)資標準為(wei)1910元、1730元、1550元;小時最低(di)(di)工(gong)資標準為(wei)19.1元、17.3元、15.5元(各市最低(di)(di)工(gong)資標準見附(fu)圖(tu))。
二(er)、月最低工資(zi)標準適用于全(quan)日制就業(ye)勞動者(zhe);小(xiao)時最低工資(zi)標準適用于非全(quan)日制就業(ye)勞動者(zhe)。
三、各地要加(jia)強(qiang)對《最(zui)低(di)工(gong)(gong)資(zi)規定(ding)(ding)》(原勞(lao)(lao)動和社(she)會保障(zhang)部(bu)令第21號)和最(zui)低(di)工(gong)(gong)資(zi)標(biao)準的(de)(de)宣傳,在當地主要媒體(ti)上公布最(zui)低(di)工(gong)(gong)資(zi)標(biao)準,讓用人單(dan)(dan)位、勞(lao)(lao)動者(zhe)和公眾廣為(wei)了解。要進一步加(jia)強(qiang)對用人單(dan)(dan)位執行(xing)最(zui)低(di)工(gong)(gong)資(zi)標(biao)準情況的(de)(de)監督(du)檢查,依法查處違反《最(zui)低(di)工(gong)(gong)資(zi)規定(ding)(ding)》的(de)(de)行(xing)為(wei),切實維(wei)護勞(lao)(lao)動者(zhe)合法權益。
另:最低工資≠標準工資
值得(de)注意的(de)(de)是,最低(di)(di)(di)工(gong)(gong)資(zi)(zi)(zi)標準(zhun)不(bu)包含延長工(gong)(gong)作(zuo)時(shi)間工(gong)(gong)資(zi)(zi)(zi),中(zhong)班、夜班、高溫、低(di)(di)(di)溫、井下、有(you)(you)毒(du)有(you)(you)害等特殊工(gong)(gong)作(zuo)環境、條件(jian)(jian)下的(de)(de)津貼,以及法(fa)律、法(fa)規和(he)國家規定(ding)(ding)的(de)(de)勞(lao)(lao)動(dong)者福利待(dai)遇等。對(dui)勞(lao)(lao)動(dong)者包吃住屬于用(yong)人單(dan)位(wei)給予(yu)職工(gong)(gong)的(de)(de)福利,用(yong)人單(dan)位(wei)不(bu)能將(jiang)此計(ji)(ji)算在工(gong)(gong)資(zi)(zi)(zi)之內,更不(bu)能因此使支付的(de)(de)貨(huo)幣(bi)工(gong)(gong)資(zi)(zi)(zi)低(di)(di)(di)于最低(di)(di)(di)工(gong)(gong)資(zi)(zi)(zi)標準(zhun)。實行計(ji)(ji)件(jian)(jian)工(gong)(gong)資(zi)(zi)(zi)制(zhi)的(de)(de)用(yong)人單(dan)位(wei)必須科學合理制(zhi)定(ding)(ding)勞(lao)(lao)動(dong)定(ding)(ding)額,確定(ding)(ding)基本計(ji)(ji)件(jian)(jian)單(dan)價(jia)和(he)超額計(ji)(ji)件(jian)(jian)單(dan)價(jia),勞(lao)(lao)動(dong)者提(ti)供正常(chang)勞(lao)(lao)動(dong)并(bing)按基本計(ji)(ji)件(jian)(jian)單(dan)價(jia)計(ji)(ji)算的(de)(de)工(gong)(gong)資(zi)(zi)(zi),不(bu)得(de)低(di)(di)(di)于最低(di)(di)(di)工(gong)(gong)資(zi)(zi)(zi)標準(zhun)。勞(lao)(lao)動(dong)者個人應當繳納的(de)(de)社會保險費和(he)住房公積(ji)金包含在最低(di)(di)(di)工(gong)(gong)資(zi)(zi)(zi)標準(zhun)之內。
山東2018年企業工資指導線
山東省人民政府還發布了2018年企業工資指導線,其中增長上線為11%、基準線為7%、下線為3%。這是山東連(lian)續9年(nian)(nian)調整最低工資(zi)標準,連(lian)續20年(nian)(nian)發布企業工資(zi)指導(dao)線。
企業(ye)(ye)(ye)工(gong)資(zi)指導線(xian)是(shi)企業(ye)(ye)(ye)與(yu)職工(gong)開展工(gong)資(zi)集體協商的重(zhong)要基礎(chu)。企業(ye)(ye)(ye)薪酬調查數據顯示,山東(dong)省(sheng)企業(ye)(ye)(ye)人工(gong)成本(ben)(ben)在(zai)全國處于中(zhong)等偏(pian)下水(shui)平,2011—2016年山東(dong)省(sheng)企業(ye)(ye)(ye)人工(gong)成本(ben)(ben)占(zhan)總成本(ben)(ben)比重(zhong)為12.25%,其中(zhong)勞(lao)動報酬占(zhan)總成本(ben)(ben)比重(zhong)為8.5%,社會保險費(fei)用占(zhan)總成本(ben)(ben)比重(zhong)為1.9%,企業(ye)(ye)(ye)職工(gong)工(gong)資(zi)仍有一定的增長空間(jian)。
