根據安(an)(an)(an)(an)徽省(sheng)(sheng)人力資源和(he)社會(hui)保障廳、安(an)(an)(an)(an)徽省(sheng)(sheng)衛生(sheng)(sheng)和(he)計劃生(sheng)(sheng)育(yu)委員(yuan)會(hui)、安(an)(an)(an)(an)徽省(sheng)(sheng)安(an)(an)(an)(an)全(quan)生(sheng)(sheng)產監(jian)督管理局、安(an)(an)(an)(an)徽省(sheng)(sheng)總工(gong)會(hui)4部門共同發布的《關(guan)于調整我省(sheng)(sheng)高溫(wen)津貼(tie)標(biao)準的通知(zhi)》(皖人社秘〔2018〕272號)。自2018年5月1日起,安(an)(an)(an)(an)徽省(sheng)(sheng)高溫(wen)津貼(tie)標(biao)準如下(xia):
一(yi)、企(qi)業(ye)、事業(ye)單位(wei)和個體經濟(ji)組織等用人(ren)單位(wei)(以(yi)下(xia)統稱用人(ren)單位(wei))安排勞動者在高(gao)(gao)溫(wen)天(tian)氣(qi)下(xia)(日最(zui)高(gao)(gao)氣(qi)溫(wen)達到35℃及以(yi)上)露天(tian)工(gong)作(zuo)以(yi)及不能(neng)采取有效(xiao)措施將工(gong)作(zuo)場(chang)所溫(wen)度降(jiang)低到33℃以(yi)下(xia)的(不含33℃),應當向(xiang)勞動者支付高(gao)(gao)溫(wen)津貼(tie),津貼(tie)標準每人(ren)每工(gong)作(zuo)日不低于15元。氣(qi)溫(wen)以(yi)省(sheng)氣(qi)象(xiang)主(zhu)管部門(men)所屬氣(qi)象(xiang)臺(tai)站(zhan)發布的為準。
二(er)、用人單位應結合(he)生產(chan)經營特點和(he)具(ju)體(ti)條件,建立高溫(wen)津(jin)貼(tie)制度,并通過平等協(xie)商合(he)理確定本單位的(de)高溫(wen)津(jin)貼(tie)發放范(fan)圍(wei)及具(ju)體(ti)標準。
三、用人單位(wei)在高(gao)溫天氣期(qi)間,應遵(zun)守國家(jia)、省防治高(gao)溫職(zhi)業危害有關規(gui)定,根據本(ben)單位(wei)實際,合理安排職(zhi)工工作(zuo),適當調整高(gao)溫、露天作(zuo)業人員的作(zuo)息時(shi)(shi)間,增加(jia)休息,減輕勞動強度,減少(shao)或(huo)停止(zhi)高(gao)溫時(shi)(shi)段作(zuo)業,嚴格控制加(jia)班加(jia)點,確(que)保勞動者身體健康和生命(ming)安全。
四、用(yong)人單位不得(de)因(yin)(yin)高溫(wen)(wen)停止(zhi)工(gong)(gong)(gong)作(zuo)、縮短(duan)工(gong)(gong)(gong)作(zuo)時間而(er)扣除(chu)或降(jiang)低勞動者(zhe)工(gong)(gong)(gong)資(zi),不得(de)因(yin)(yin)增加高溫(wen)(wen)津貼(tie)(tie)(tie)而(er)降(jiang)低勞動者(zhe)工(gong)(gong)(gong)資(zi)。最低工(gong)(gong)(gong)資(zi)標準不包(bao)含高溫(wen)(wen)津貼(tie)(tie)(tie)。高溫(wen)(wen)津貼(tie)(tie)(tie)計(ji)入(ru)工(gong)(gong)(gong)資(zi)總額,在用(yong)人單位成(cheng)本中(zhong)列支。
