生育(yu)保(bao)(bao)險是通(tong)過國(guo)家(jia)立法(fa)規定,在(zai)勞(lao)動(dong)(dong)者因生育(yu)子女而(er)導致勞(lao)動(dong)(dong)力暫時(shi)(shi)中(zhong)斷時(shi)(shi),由國(guo)家(jia)和社會及時(shi)(shi)給(gei)予(yu)物質幫(bang)助的(de)一項社會保(bao)(bao)險制度。我(wo)國(guo)生育(yu)保(bao)(bao)險待(dai)(dai)遇主要包括兩項。一是生育(yu)津(jin)貼,二是生育(yu)醫(yi)療(liao)待(dai)(dai)遇。其(qi)宗旨在(zai)于通(tong)過向職業(ye)婦女提供生育(yu)津(jin)貼、醫(yi)療(liao)服務和產假(jia),幫(bang)助他們恢(hui)復勞(lao)動(dong)(dong)能力,重(zhong)返工作崗位。
凡(fan)是(shi)與用人單位建立了勞動(dong)關(guan)系的職(zhi)工,包括男(nan)職(zhi)工,都應當參加(jia)生育(yu)保險。
用人單位按照(zhao)國家規定繳納生(sheng)育(yu)保(bao)險(xian)費(fei),職工不繳納生(sheng)育(yu)保(bao)險(xian)費(fei)。
北京生育(yu)保險(xian)繳(jiao)(jiao)費(fei)比例(li)為:企(qi)業按照職工繳(jiao)(jiao)費(fei)基數的0.80%繳(jiao)(jiao)納生育(yu)保險(xian)費(fei);
廣州生(sheng)(sheng)育(yu)保(bao)(bao)險(xian)繳(jiao)費比例為(wei):企業按照職工(gong)繳(jiao)費基數(shu)的0.85%繳(jiao)納生(sheng)(sheng)育(yu)保(bao)(bao)險(xian)費。
報銷
生育保險報銷條件
職工享(xiang)受(shou)生(sheng)育保險待遇,應當同時具備下列條件:
1、用人(ren)單位為職工(gong)累計繳費滿(man)1年以上,并且(qie)繼續(xu)為其繳費;
2、符合國(guo)家和省人口與計劃生育規(gui)定。
女職工生(sheng)育(yu)的檢查費(fei)(fei)(fei)(fei)、接生(sheng)費(fei)(fei)(fei)(fei)、手術費(fei)(fei)(fei)(fei)、住(zhu)院費(fei)(fei)(fei)(fei)和(he)藥(yao)費(fei)(fei)(fei)(fei)由(you)生(sheng)育(yu)保險基(ji)金支付。超出規定的醫(yi)療業務費(fei)(fei)(fei)(fei)和(he)藥(yao)費(fei)(fei)(fei)(fei)(含自費(fei)(fei)(fei)(fei)藥(yao)品和(he)營(ying)養藥(yao)品的藥(yao)費(fei)(fei)(fei)(fei))由(you)職工個人負擔。
女職工生(sheng)育出院后,因生(sheng)育引起疾病的(de)醫療(liao)費,由生(sheng)育保(bao)(bao)(bao)險基金支付(fu);其它疾病的(de)醫療(liao)費,按照(zhao)醫療(liao)保(bao)(bao)(bao)險待遇的(de)規定辦理。女職工產假期滿后,因病需要(yao)休息治療(liao)的(de),按照(zhao)有關病假待遇和醫療(liao)保(bao)(bao)(bao)險待遇規定辦理。
女(nv)職工(gong)(gong)依法享(xiang)受產假期間的生(sheng)育津(jin)貼,按(an)本企業(ye)上(shang)年度職工(gong)(gong)月平均工(gong)(gong)資計(ji)發,由(you)生(sheng)育保險基(ji)金支付。
基本產假98天,其中產前可(ke)以(yi)休(xiu)假15天;
生育時遇有難產的(如剖腹產、Ⅲ度會陰破裂(lie)者),可增加產假(jia)30天;
懷孕不滿四個(ge)月(yue)流產的(de),根據醫(yi)務部門的(de)意見,給(gei)予15天(tian)至(zhi)30天(tian)的(de)產假(jia);
懷孕四個月以上(含四個月)流產的,給(gei)予42天產假;
自愿生(sheng)育(yu)獨生(sheng)子女(nv)的,增加35天(tian);
晚育的(de),增加(jia)15天;
按所屬統(tong)籌(chou)地區上年度(du)在崗職工月平(ping)均(jun)工資的一定(ding)(ding)比例計發。具體比例由統(tong)籌(chou)地區人民政(zheng)府確(que)定(ding)(ding)。
包(bao)括職工因為(wei)計劃生育(yu)實施放置(zhi)或者取出宮內(nei)節育(yu)器(qi)、流產(chan)術、引產(chan)術、絕育(yu)及復通手術所發生的(de)醫(yi)療費用。
已參保的男職(zhi)工按規定享受(shou)的看護假假期(qi)(qi)津貼,以所屬統籌(chou)地區上年度在(zai)崗職(zhi)工月(yue)平均工資為基數,按規定的假期(qi)(qi)時(shi)間計發。
看(kan)護(hu)假(jia)津貼=當月本(ben)單位人平(ping)繳費工資÷30(天)×假(jia)期天數
生育保險基金不予支付下列費(fei)用(yong):
1、不(bu)符合國家(jia)和省城鎮職(zhi)工基本醫(yi)療(liao)保險和生育(yu)保險的(de)藥品(pin)目(mu)錄、診療(liao)項目(mu)、醫(yi)療(liao)服務設施項目(mu)及相關就醫(yi)管理規定的(de)費(fei)用(yong);
2、因為醫療事故(gu)發生的費用;
3、分(fen)娩期外(wai)治(zhi)療生育并發癥(zheng)的費用。
我國生(sheng)育保險(xian)的現(xian)狀是實行兩種制度并(bing)存(cun):
第一(yi)種是由女職工(gong)(gong)(gong)(gong)所在單(dan)位負擔生(sheng)育(yu)女職工(gong)(gong)(gong)(gong)的產假(jia)工(gong)(gong)(gong)(gong)資和生(sheng)育(yu)醫療費(fei)(fei)(fei)。根據(ju)國(guo)務院《女職工(gong)(gong)(gong)(gong)勞動保護規(gui)定》以及勞動部《關于女職工(gong)(gong)(gong)(gong)生(sheng)育(yu)待遇若干問(wen)題的通知》,女職工(gong)(gong)(gong)(gong)懷孕期間的檢查(cha)費(fei)(fei)(fei)、接生(sheng)費(fei)(fei)(fei)、手(shou)術費(fei)(fei)(fei)、住(zhu)院費(fei)(fei)(fei)和藥費(fei)(fei)(fei)由所在單(dan)位負擔。產假(jia)期間工(gong)(gong)(gong)(gong)資照(zhao)發。
第二種是生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)社會(hui)(hui)保(bao)(bao)險。根(gen)據勞動(dong)部(bu)《企業(ye)職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)保(bao)(bao)險試行辦法》規定,參加生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)保(bao)(bao)險社會(hui)(hui)統(tong)籌的(de)(de)用人(ren)單位,應向當地社會(hui)(hui)保(bao)(bao)險經辦機構繳(jiao)納生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)保(bao)(bao)險費(fei)(fei)(fei)(fei)(fei)(fei);生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)保(bao)(bao)險費(fei)(fei)(fei)(fei)(fei)(fei)的(de)(de)繳(jiao)費(fei)(fei)(fei)(fei)(fei)(fei)比例(li)由當地人(ren)民政(zheng)府(fu)根(gen)據計(ji)劃內生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)女職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)的(de)(de)生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)津貼(tie)、生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)醫療(liao)費(fei)(fei)(fei)(fei)(fei)(fei)支(zhi)出情況等確定,最高不得超(chao)過工(gong)(gong)(gong)(gong)(gong)資總(zong)額(e)的(de)(de)1%,職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)個(ge)人(ren)不繳(jiao)費(fei)(fei)(fei)(fei)(fei)(fei)。參保(bao)(bao)單位女職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)或(huo)流(liu)產后(hou),其生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)津貼(tie)和(he)生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)醫療(liao)費(fei)(fei)(fei)(fei)(fei)(fei)由生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)保(bao)(bao)險基金(jin)支(zhi)付。生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)津貼(tie)按照本(ben)企業(ye)上年度職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)月平均工(gong)(gong)(gong)(gong)(gong)資計(ji)發;生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)醫療(liao)費(fei)(fei)(fei)(fei)(fei)(fei)包括女職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)或(huo)流(liu)產的(de)(de)檢查費(fei)(fei)(fei)(fei)(fei)(fei)、接生(sheng)(sheng)(sheng)費(fei)(fei)(fei)(fei)(fei)(fei)、手術費(fei)(fei)(fei)(fei)(fei)(fei)、住院費(fei)(fei)(fei)(fei)(fei)(fei)和(he)藥費(fei)(fei)(fei)(fei)(fei)(fei)(超(chao)出規定的(de)(de)醫療(liao)服務費(fei)(fei)(fei)(fei)(fei)(fei)和(he)藥費(fei)(fei)(fei)(fei)(fei)(fei)由職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)個(ge)人(ren)負擔(dan))以及女職(zhi)(zhi)工(gong)(gong)(gong)(gong)(gong)生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)出院后(hou),因生(sheng)(sheng)(sheng)育(yu)(yu)(yu)(yu)引起疾(ji)病的(de)(de)醫療(liao)費(fei)(fei)(fei)(fei)(fei)(fei)。

(2)生(sheng)育或施(shi)行計(ji)劃(hua)生(sheng)育手術(shu)符(fu)合國家計(ji)劃(hua)生(sheng)育政策的職(zhi)工。

生(sheng)(sheng)育(yu)保(bao)險(xian)費用結(jie)算(suan)辦法系指社會保(bao)險(xian)經辦機構(gou)支付(fu)(fu)生(sheng)(sheng)育(yu)保(bao)險(xian)范圍內的醫療服務發生(sheng)(sheng)費用的方式。目前,國際上采用的結(jie)算(suan)辦法有:按病種付(fu)(fu)費、按項目付(fu)(fu)費、按人頭付(fu)(fu)費等。青島(dao)市在實踐中(zhong)摸索出一條適(shi)合(he)我(wo)國生(sheng)(sheng)育(yu)保(bao)險(xian)醫療費用結(jie)算(suan)辦法。
生育(yu)保險費(fei)用(yong)結算(suan)(suan)辦(ban)(ban)(ban)法系指社會保險經(jing)辦(ban)(ban)(ban)機構支付生育(yu)保險范(fan)圍內的(de)(de)醫療服務發生費(fei)用(yong)的(de)(de)方式。目前,國(guo)際上采用(yong)的(de)(de)結算(suan)(suan)辦(ban)(ban)(ban)法有:按病種(zhong)(zhong)付費(fei)、按項目付費(fei)、按人頭付費(fei)等。青島市(shi)在(zai)實踐中(zhong)摸索(suo)出一條適合我(wo)國(guo)生育(yu)保險醫療費(fei)用(yong)結算(suan)(suan)辦(ban)(ban)(ban)法。采取的(de)(de)辦(ban)(ban)(ban)法是(shi)女職工到定點醫院生育(yu),社會保險經(jing)辦(ban)(ban)(ban)機構與定點醫院實行定額結算(suan)(suan)。這種(zhong)(zhong)結算(suan)(suan)辦(ban)(ban)(ban)法的(de)(de)主要步驟(zou)是(shi):
參(can)保(bao)職工在同時(shi)具備(bei)下列條件時(shi),可按規定享(xiang)受生育保(bao)險待遇:
1、符(fu)合國家(jia)、省、市計劃生育政(zheng)策規定(ding);
2、分娩或實施計劃生(sheng)育手術時(shi),用人單位(wei)已為其參加生(sheng)育保險且(qie)連續足(zu)額繳納生(sheng)育保險費滿(man)12個月。
3、產前檢(jian)查費和生(sheng)(sheng)產費用,當事人攜帶結(jie)婚證、社保卡(ka)(市民卡(ka))及街道開具(ju)的計生(sheng)(sheng)證明到生(sheng)(sheng)育(yu)保險定點醫院直接刷卡(ka)結(jie)算。
4、申報生育(yu)津貼和一(yi)次性營(ying)養(yang)補貼,需(xu)填寫《生育(yu)保險待遇申報表》并加(jia)蓋(gai)單(dan)位(wei)公章(zhang),提供結(jie)婚證、獨生子女證(孩子的)、出院(yuan)小結(jie)等(deng)材料,于每月1-10日(ri)之間的工(gong)作日(ri)前往市醫保中心(xin)生育(yu)科辦理申報手續。(相(xiang)關手續應在分(fen)娩后一(yi)年內(nei)辦理)
1、生育保險可以轉移嗎?
生育保(bao)險是不(bu)能轉移(yi)的(de)。同時不(bu)能轉移(yi)的(de)保(bao)險還(huan)包括(kuo)失業保(bao)險及工傷保(bao)險。但(dan)是養老保(bao)險可以跨省轉移(yi),醫療保(bao)險可以轉劃,住房公(gong)積金可以一次性轉移(yi)賬(zhang)戶全(quan)部(bu)余額。
2、生育保險可以補辦嗎?

3、營養費是每個女職工都可以享受的嗎?
是(shi),只要是(shi)符(fu)合(he)國家政策合(he)法生(sheng)育(yu)的(de)同胞都應該享受生(sheng)育(yu)時的(de)營養(yang)費補(bu)貼:順(shun)產(chan)945元。剖腹產(chan)1890元。
4、靈活就業人員該如何享受生育保險的福利?
