勞動保險條例實施細則2015修正案(全文)
第一章關于實施范圍的規定
第一條中華人民共和國勞動保險條例(以下(xia)簡(jian)稱勞動保險條例)第二條甲款(kuan)關于(yu)“有工(gong)(gong)人(ren)(ren)職員(yuan)一百(bai)人(ren)(ren)以上”的(de)規定,系指工(gong)(gong)廠、礦場本身的(de)工(gong)(gong)人(ren)(ren)職員(yuan)人(ren)(ren)數(shu)(shu)而(er)言,其業務管理機關及附屬單(dan)位人(ren)(ren)數(shu)(shu)不包括(kuo)在內。在計算人(ren)(ren)數(shu)(shu)時,應(ying)包括(kuo)工(gong)(gong)資制(zhi)、供(gong)給(gei)制(zhi)人(ren)(ren)員(yuan)及學徒(tu)、臨時工(gong)(gong)(臨時性的建筑(zhu)工人及搬運(yun)工人除外)試用人員在(zai)內。
第二(er)條凡實行(xing)勞(lao)動保(bao)險的企(qi)(qi)業(ye)(ye),其業(ye)(ye)務管(guan)理(li)機關(guan)與附屬(shu)單位(wei),應與企(qi)(qi)業(ye)(ye)同時(shi)實行(xing)勞(lao)動保(bao)險條例。“業(ye)(ye)務管(guan)理(li)機關(guan)”系(xi)指(zhi)其全部經費由業(ye)(ye)務收入或(huo)基(ji)本建設(she)費或(huo)事業(ye)(ye)費內開(kai)支的機構而言(yan)。“附屬(shu)單位(wei)”系(xi)指(zhi)企(qi)(qi)業(ye)(ye)中所附設(she)的有關(guan)業(ye)(ye)務及職工文(wen)化(hua)教育(yu)、福利等機構而言(yan)。
第三條凡在實行勞動保險的企業附屬單位內工作的工人職員及工會的工作人員,不由企業行政方面或資方直接支付工資者,其生育假期工資、病傷假期工資及因工死亡喪葬費由支付工資的單位付給,支付工資的單位應按各該單位工人職員的工資總額百分之三繳納勞動保險金(原在企業工作的工會(hui)基層委員會(hui)脫離(li)生產的委員,其勞動保險(xian)金可以免繳),交由(you)企(qi)業行(xing)政方(fang)(fang)面(mian)或資方(fang)(fang)一并繳納。工(gong)人職員(yuan)及(ji)工(gong)會的工(gong)作人員(yuan)醫療期間的醫藥費用,按勞動保險(xian)條例的規定,由(you)企(qi)業行(xing)政方(fang)(fang)面(mian)或資方(fang)(fang)負擔(dan)。
第四條(tiao)在實行(xing)勞(lao)動保險(xian)(xian)的(de)企(qi)業(ye)中(zhong)的(de)供給(gei)制人(ren)員,仍(reng)應按(an)供給(gei)制的(de)規定辦理,不(bu)適用(yong)勞(lao)動保險(xian)(xian)條(tiao)例。廠礦企(qi)業(ye)的(de)武裝警(jing)衛人(ren)員,如系屬于(yu)人(ren)民解放軍建制的(de)現(xian)役軍人(ren),仍(reng)應享受(shou)人(ren)民解放軍的(de)各種待遇,不(bu)適用(yong)勞(lao)動保險(xian)(xian)條(tiao)例。
第五(wu)條不實(shi)(shi)行(xing)勞(lao)動(dong)(dong)保(bao)(bao)險條例(li)(li)的(de)(de)企業訂(ding)立勞(lao)動(dong)(dong)保(bao)(bao)險集體(ti)(ti)合同(tong)時,應(ying)根據勞(lao)動(dong)(dong)保(bao)(bao)險條例(li)(li)的(de)(de)精神,及本(ben)企業、本(ben)產業或(huo)本(ben)行(xing)業的(de)(de)實(shi)(shi)際情況協商(shang)簽訂(ding),并(bing)報請所(suo)(suo)在(zai)地勞(lao)動(dong)(dong)行(xing)政機關批(pi)準實(shi)(shi)行(xing)。集體(ti)(ti)合同(tong)中(zhong)所(suo)(suo)規定的(de)(de)各(ge)項(xiang)勞(lao)動(dong)(dong)保(bao)(bao)險費(fei)用(yong),均由企業行(xing)政方(fang)(fang)面或(huo)資方(fang)(fang)負擔。
第二章關于工資總額的規定
第六條實行勞動保險的(de)企業,按照勞(lao)動保險(xian)條(tiao)例第八條(tiao)的(de)規(gui)定,繳納(na)勞(lao)動保險(xian)金時(shi),工資總額的(de)計算,應依照中央人(ren)民(min)政(zheng)府政(zheng)務(wu)院財政(zheng)經濟委員會“關于工資總額組(zu)成的(de)規(gui)定”辦理。
第三章關于勞動保險待遇計算標準的規定
第七條工(gong)人(ren)(ren)職(zhi)員的工(gong)資(zi)按日(ri)或按月計算者,享(xiang)受勞動保險待遇時,如按本人(ren)(ren)工(gong)資(zi)計算,均以該工(gong)人(ren)(ren)職(zhi)員每日(ri)或每月所得工(gong)資(zi)為計算標準。
第八(ba)條工(gong)人職員的工(gong)資按件計(ji)(ji)算(suan)者,享受勞動保險待遇時,如按本人工(gong)資計(ji)(ji)算(suan),均(jun)(jun)以(yi)該工(gong)人職員最近三個月的每(mei)日(ri)平(ping)均(jun)(jun)工(gong)資為計(ji)(ji)算(suan)標(biao)準。如全部工(gong)作(zuo)(zuo)時間不滿(man)三個月者,應以(yi)該工(gong)人職員實際工(gong)作(zuo)(zuo)日(ri)的每(mei)日(ri)平(ping)均(jun)(jun)工(gong)資為計(ji)(ji)算(suan)標(biao)準。但病傷假期(qi)在七日(ri)以(yi)內者,得(de)以(yi)上月份每(mei)日(ri)平(ping)均(jun)(jun)工(gong)資為計(ji)(ji)算(suan)標(biao)準。
第九條領取因(yin)工(gong)(gong)(gong)殘(can)廢(fei)(fei)補助(zhu)費(fei)(fei)的工(gong)(gong)(gong)人(ren)職員退職或(huo)死亡時(shi)(shi),在勞動(dong)保險基金(jin)項下(xia)領取以(yi)本(ben)人(ren)工(gong)(gong)(gong)資(zi)為計(ji)算標(biao)準(zhun)的撫恤費(fei)(fei)、救濟費(fei)(fei)或(huo)補助(zhu)費(fei)(fei)時(shi)(shi),其本(ben)人(ren)工(gong)(gong)(gong)資(zi),應將所得工(gong)(gong)(gong)資(zi)與因(yin)工(gong)(gong)(gong)殘(can)廢(fei)(fei)補助(zhu)費(fei)(fei)合并計(ji)算。
第十條學徒的(de)(de)本(ben)人(ren)(ren)工(gong)(gong)(gong)資(zi)低(di)于該企業普(pu)通工(gong)(gong)(gong)人(ren)(ren)的(de)(de)最低(di)工(gong)(gong)(gong)資(zi)者(zhe),以本(ben)人(ren)(ren)工(gong)(gong)(gong)資(zi)計(ji)算勞動保險費(fei)(fei)時,應改按該企業普(pu)通工(gong)(gong)(gong)人(ren)(ren)的(de)(de)最低(di)工(gong)(gong)(gong)資(zi)計(ji)算,但其所得(de)(de)的(de)(de)勞動保險費(fei)(fei),不得(de)(de)超(chao)過本(ben)人(ren)(ren)工(gong)(gong)(gong)資(zi)。
第四章關于因工負傷、殘廢、死亡待遇的規定
第十一條工人(ren)職員在(zai)下列情況(kuang)下負傷(shang)、殘廢或死(si)亡時,應享受因工負傷(shang)、殘廢或死(si)亡的待遇:
一、由于執行(xing)(xing)(xing)日常(chang)工作(zuo)以(yi)及執行(xing)(xing)(xing)企(qi)業行(xing)(xing)(xing)政(zheng)方面(mian)或資方臨時指定或同意的工作(zuo);
二、在(zai)緊急情況下未經企業行政方面或資方指定而從事與企業有(you)利的工作(zuo);
三、由于從事發明(ming)或技術改進(jin)的(de)工作。
關于因工或非因工的確定,由工會小組據實報告工會基層委員會勞動保險委員會(以下(xia)簡(jian)稱勞動(dong)保險委員會)審查(cha)確(que)定(ding)后,報請工(gong)會(hui)基層委員會(hui)通知企業行(xing)政(zheng)方(fang)面或(huo)資方(fang)及工(gong)人(ren)職員本(ben)人(ren)或(huo)其供養直(zhi)系親屬。如有不同意見時,應(ying)報請當(dang)地(di)人(ren)民政(zheng)府勞動行(xing)政(zheng)機關迅速處(chu)理,但(dan)在(zai)未處(chu)理以前,應(ying)按工(gong)會(hui)基層委員會(hui)的通知辦(ban)理。
第(di)十二條(tiao)勞(lao)動(dong)保(bao)險(xian)條(tiao)例第(di)十二條(tiao)丙款規(gui)定的殘廢(fei)審(shen)查委(wei)員(yuan)會(hui)(hui),應(ying)在市工(gong)會(hui)(hui)組(zu)(zu)織(zhi)或產業(ye)(ye)工(gong)會(hui)(hui)地(di)方(fang)組(zu)(zu)織(zhi)領導下(xia)建立(li)之,其人(ren)選由(you)上述(shu)工(gong)會(hui)(hui)組(zu)(zu)織(zhi),勞(lao)動(dong)行(xing)政(zheng)機關(guan)及(ji)衛生行(xing)政(zheng)機關(guan)的代(dai)表(biao)(biao)三人(ren)至七(qi)人(ren)組(zu)(zu)成,以市工(gong)會(hui)(hui)組(zu)(zu)織(zhi)或產業(ye)(ye)工(gong)會(hui)(hui)地(di)方(fang)組(zu)(zu)織(zhi)的代(dai)表(biao)(biao)為召集(ji)人(ren),殘廢(fei)的工(gong)人(ren)職員(yuan)所屬企(qi)(qi)業(ye)(ye)勞(lao)動(dong)保(bao)險(xian)委(wei)員(yuan)會(hui)(hui)的代(dai)表(biao)(biao)及(ji)主治醫師得列(lie)席會(hui)(hui)議(yi)。只有(you)個別企(qi)(qi)業(ye)(ye)實行(xing)勞(lao)動(dong)保(bao)險(xian)條(tiao)例的地(di)方(fang),不(bu)組(zu)(zu)織(zhi)殘廢(fei)審(shen)查委(wei)員(yuan)會(hui)(hui),由(you)該企(qi)(qi)業(ye)(ye)勞(lao)動(dong)保(bao)險(xian)委(wei)員(yuan)會(hui)(hui)代(dai)行(xing)其職權(quan)。殘廢(fei)審(shen)查委(wei)員(yuan)會(hui)(hui)的職權(quan)如下(xia):
一、確定殘廢工人職員的殘廢狀況;
二、每(mei)六(liu)個月檢查殘(can)(can)廢者的殘(can)(can)廢狀(zhuang)況(kuang)一(yi)次(ci),以確定其(qi)殘(can)(can)廢狀(zhuang)況(kuang)有無變更,但殘(can)(can)廢者請求審查殘(can)(can)廢狀(zhuang)況(kuang)時,得隨(sui)時審查之。
第十(shi)三(san)(san)條因工(gong)(gong)(gong)(gong)殘(can)(can)廢部分(fen)(fen)喪失勞動力尚(shang)能工(gong)(gong)(gong)(gong)作的工(gong)(gong)(gong)(gong)人(ren)職員,根據勞動保(bao)險條例(li)第十(shi)二(er)(er)條乙款三(san)(san)項規定應領(ling)的因工(gong)(gong)(gong)(gong)殘(can)(can)廢補(bu)助(zhu)費,按(an)其殘(can)(can)廢后(hou)工(gong)(gong)(gong)(gong)資(zi)(zi)減(jian)少(shao)的數額付給:工(gong)(gong)(gong)(gong)資(zi)(zi)減(jian)少(shao)百(bai)(bai)分(fen)(fen)之(zhi)(zhi)十(shi)一(yi)至(zhi)(zhi)二(er)(er)十(shi)者,其因工(gong)(gong)(gong)(gong)殘(can)(can)廢補(bu)助(zhu)費為殘(can)(can)廢前(qian)本人(ren)工(gong)(gong)(gong)(gong)資(zi)(zi)百(bai)(bai)分(fen)(fen)之(zhi)(zhi)十(shi);工(gong)(gong)(gong)(gong)資(zi)(zi)減(jian)少(shao)百(bai)(bai)分(fen)(fen)之(zhi)(zhi)二(er)(er)十(shi)一(yi)至(zhi)(zhi)三(san)(san)十(shi)者,為殘(can)(can)廢前(qian)本人(ren)工(gong)(gong)(gong)(gong)資(zi)(zi)百(bai)(bai)分(fen)(fen)之(zhi)(zhi)二(er)(er)十(shi);工(gong)(gong)(gong)(gong)資(zi)(zi)減(jian)少(shao)百(bai)(bai)分(fen)(fen)之(zhi)(zhi)三(san)(san)十(shi)以(yi)上者,一(yi)律補(bu)助(zhu)殘(can)(can)廢前(qian)本人(ren)工(gong)(gong)(gong)(gong)資(zi)(zi)百(bai)(bai)分(fen)(fen)之(zhi)(zhi)三(san)(san)十(shi)。
第十四條工人職(zhi)員因工負傷在該企(qi)業醫(yi)(yi)療所、醫(yi)(yi)院、特(te)約醫(yi)(yi)院、特(te)約中(zhong)西醫(yi)(yi)師或(huo)轉送之醫(yi)(yi)院醫(yi)(yi)療終結后,必須安(an)裝假(jia)腿、假(jia)手(shou)、鑲牙、補眼者,其所需費用,完全(quan)由企(qi)業行政方面(mian)或(huo)資方負擔(dan)。
第十(shi)五條(tiao)(tiao)工(gong)(gong)人(ren)職員因(yin)(yin)工(gong)(gong)殘(can)廢(fei)(fei)部分喪失勞(lao)動(dong)力仍繼續工(gong)(gong)作(zuo)者(zhe),再次非(fei)因(yin)(yin)工(gong)(gong)殘(can)廢(fei)(fei)仍能(neng)工(gong)(gong)作(zuo)時(shi),根據勞(lao)動(dong)保險(xian)條(tiao)(tiao)例第十(shi)二條(tiao)(tiao)乙(yi)款三(san)(san)項規(gui)定(ding)(ding)應領的因(yin)(yin)工(gong)(gong)殘(can)廢(fei)(fei)補助費,應繼續付給。再次非(fei)因(yin)(yin)工(gong)(gong)殘(can)廢(fei)(fei)完全喪失勞(lao)動(dong)力不能(neng)工(gong)(gong)作(zuo)而退職時(shi),應按(an)勞(lao)動(dong)保險(xian)條(tiao)(tiao)例第十(shi)三(san)(san)條(tiao)(tiao)丙款規(gui)定(ding)(ding)的待遇辦理。
第五章關于疾病、非因工負傷、非因工殘廢待遇的規定
第十(shi)(shi)六(liu)(liu)條(tiao)(tiao)工(gong)(gong)(gong)人職員疾病或非(fei)因工(gong)(gong)(gong)負傷停止工(gong)(gong)(gong)作連續醫(yi)療期(qi)間在六(liu)(liu)個月以內者(zhe)(zhe),根(gen)據(ju)勞(lao)動保(bao)險條(tiao)(tiao)例第十(shi)(shi)三條(tiao)(tiao)乙款的規定(ding),應(ying)由該企(qi)業行政方(fang)面(mian)或資(zi)方(fang)按(an)下列標準支付病傷假期(qi)工(gong)(gong)(gong)資(zi):本(ben)企(qi)業工(gong)(gong)(gong)齡不(bu)(bu)滿(man)(man)二(er)年(nian)(nian)(nian)(nian)(nian)者(zhe)(zhe),為本(ben)人工(gong)(gong)(gong)資(zi)百分(fen)(fen)(fen)之(zhi)六(liu)(liu)十(shi)(shi);已(yi)滿(man)(man)二(er)年(nian)(nian)(nian)(nian)(nian)不(bu)(bu)滿(man)(man)四(si)年(nian)(nian)(nian)(nian)(nian)者(zhe)(zhe),為本(ben)人工(gong)(gong)(gong)資(zi)百分(fen)(fen)(fen)之(zhi)七十(shi)(shi);已(yi)滿(man)(man)四(si)年(nian)(nian)(nian)(nian)(nian)不(bu)(bu)滿(man)(man)六(liu)(liu)年(nian)(nian)(nian)(nian)(nian)者(zhe)(zhe),為本(ben)人工(gong)(gong)(gong)資(zi)百分(fen)(fen)(fen)之(zhi)八(ba)(ba)十(shi)(shi);已(yi)滿(man)(man)六(liu)(liu)年(nian)(nian)(nian)(nian)(nian)不(bu)(bu)滿(man)(man)八(ba)(ba)年(nian)(nian)(nian)(nian)(nian)者(zhe)(zhe),為本(ben)人工(gong)(gong)(gong)資(zi)百分(fen)(fen)(fen)之(zhi)九(jiu)十(shi)(shi);已(yi)滿(man)(man)八(ba)(ba)年(nian)(nian)(nian)(nian)(nian)及八(ba)(ba)年(nian)(nian)(nian)(nian)(nian)以上者(zhe)(zhe),為本(ben)人工(gong)(gong)(gong)資(zi)百分(fen)(fen)(fen)之(zhi)一百。
第十(shi)七條(tiao)工(gong)(gong)人(ren)職員疾病或非(fei)(fei)因(yin)工(gong)(gong)負傷停(ting)(ting)止工(gong)(gong)作連續醫(yi)療期間超過六個月(yue)時,根據勞(lao)動(dong)保險(xian)條(tiao)例第十(shi)三條(tiao)乙款(kuan)的規定(ding)(ding),病傷假期工(gong)(gong)資(zi)(zi)停(ting)(ting)發,改由(you)勞(lao)動(dong)保險(xian)基(ji)金項(xiang)下,按月(yue)付給疾病或非(fei)(fei)因(yin)工(gong)(gong)負傷救(jiu)濟費(fei),其標準如下:本企業工(gong)(gong)齡不滿一年(nian)者,為本人(ren)工(gong)(gong)資(zi)(zi)百(bai)分之(zhi)四十(shi);已(yi)滿一年(nian)未滿三年(nian)者,為本人(ren)工(gong)(gong)資(zi)(zi)百(bai)分之(zhi)五(wu)十(shi);三年(nian)及三年(nian)以上(shang)者,為本人(ren)工(gong)(gong)資(zi)(zi)百(bai)分之(zhi)六十(shi)。此項(xiang)救(jiu)濟費(fei)付至能工(gong)(gong)作或確(que)定(ding)(ding)為殘廢或死亡(wang)時止。
第十(shi)八條工人(ren)職員的本人(ren)工資(zi)低于(yu)該企業(ye)的平(ping)均(jun)工資(zi)者,領取疾病或非工負傷救(jiu)濟(ji)費時,如其所(suo)得救(jiu)濟(ji)費數額低于(yu)該企業(ye)平(ping)均(jun)工資(zi)百分之(zhi)四(si)(si)十(shi),應(ying)按(an)平(ping)均(jun)工資(zi)的百分之(zhi)四(si)(si)十(shi)發給,但不得高于(yu)本人(ren)工資(zi)。
第十九(jiu)條(tiao)工(gong)人職員因工(gong)廢(fei)殘(can)完全喪(sang)失勞(lao)動(dong)力而退職者及退職養老者,本人仍得按(an)勞(lao)動(dong)保險條(tiao)例第十三條(tiao)甲款的(de)規定,繼續享受疾病醫(yi)療待遇至死亡時止。
第二十條工人職(zhi)員疾病或非(fei)因(yin)工負傷醫療終結,確定為殘廢(fei)完全喪失勞動(dong)力退(tui)職(zhi)后,除領(ling)取非(fei)因(yin)工殘廢(fei)救濟費、本人死(si)亡時的喪葬補助費及供養(yang)直系(xi)親屬(shu)救濟費外,其(qi)他勞動(dong)保險待(dai)遇應停止享受(shou)。
第二十一條工(gong)(gong)人職員疾病(bing)或非因工(gong)(gong)負(fu)(fu)(fu)傷需要(yao)停止工(gong)(gong)作醫療者,須(xu)經負(fu)(fu)(fu)責(ze)醫療機(ji)關(guan)提(ti)出證(zheng)(zheng)(zheng)明,如(ru)當(dang)時(shi)無法取得上項(xiang)證(zheng)(zheng)(zheng)明,須(xu)由(you)工(gong)(gong)會小(xiao)組(zu)長或小(xiao)組(zu)勞(lao)動(dong)保(bao)(bao)險(xian)干事證(zheng)(zheng)(zheng)明,始得享受勞(lao)動(dong)保(bao)(bao)險(xian)待(dai)遇。病(bing)愈復工(gong)(gong)時(shi),應取得負(fu)(fu)(fu)責(ze)醫療機(ji)關(guan)提(ti)出能工(gong)(gong)作的證(zheng)(zheng)(zheng)明。
第六章關于死亡待遇的規定
第二十二條工人職員因工死亡時或因工殘廢退職后死亡時,根據勞動保險條例第十四條甲款的規定,由企業行政方面或資方發給本企業的平均工資三個月作為喪葬費,并按下列規定,由勞動保險基金項下每月付給供養直系親屬撫恤費:其供養直系親屬一人者,為死者本人工資百分之二十五;二人者,為死者本人工資百分之四十;三人或三人以上者,為死者本人工資百分之五十。此項撫恤費付至受供養者失去受供養的條件時止(供養(yang)條件見第十(shi)一章的規定)。
第(di)二十(shi)三(san)條工(gong)(gong)人(ren)職(zhi)員因病或非(fei)因工(gong)(gong)負(fu)傷死亡時(shi)、退(tui)職(zhi)養老后死亡時(shi)或非(fei)因工(gong)(gong)殘廢完全(quan)喪失勞動力退(tui)職(zhi)后死亡時(shi),根(gen)據勞動保險條例(li)第(di)十(shi)四條乙款的規定,除由勞動保險基金(jin)項下付給本(ben)(ben)企業的平(ping)均工(gong)(gong)資(zi)二個月(yue)作為喪葬(zang)補(bu)助費外,并按下列規定由勞動保險基金(jin)項下一(yi)次(ci)付給供(gong)養直(zhi)系親(qin)屬(shu)救(jiu)濟費:其供(gong)養直(zhi)系親(qin)屬(shu)一(yi)人(ren)者(zhe)(zhe),為死者(zhe)(zhe)本(ben)(ben)人(ren)工(gong)(gong)資(zi)六個月(yue);二人(ren)者(zhe)(zhe),為死者(zhe)(zhe)本(ben)(ben)人(ren)工(gong)(gong)資(zi)九個月(yue);三(san)人(ren)或三(san)人(ren)以上(shang)者(zhe)(zhe),為死者(zhe)(zhe)本(ben)(ben)人(ren)工(gong)(gong)資(zi)十(shi)二個月(yue)。
第二(er)十四條工(gong)人職員因工(gong)死亡或(huo)因工(gong)殘廢完全喪失勞動力(li),其(qi)直系(xi)親(qin)屬具有工(gong)作能(neng)力(li)而(er)該企業(ye)需人工(gong)作時,行(xing)政方面或(huo)資方應盡先錄用;受其(qi)供養的(de)子、女、弟、妹有入該企業(ye)所辦(ban)學校(xiao)就讀(du)的(de)權利(li)。
第二十五條全(quan)家有兩(liang)人(ren)或兩(liang)人(ren)以上在實行(xing)勞動保險的企業內工作或共同供養的直(zhi)系(xi)親屬死亡時(shi),喪葬補助費應由其中一人(ren)領取,不得重領。
第七章關于養老待遇的規定
第二十(shi)六條(tiao)工(gong)(gong)人(ren)職員退職養(yang)老時(shi),應由勞動保險基金項下按月付(fu)給退職養(yang)老補助費(fei):本(ben)企業工(gong)(gong)齡已(yi)滿(man)五(wu)年(nian)(nian)不滿(man)十(shi)年(nian)(nian)者(zhe),付(fu)給本(ben)人(ren)工(gong)(gong)資百(bai)分之(zhi)五(wu)十(shi);已(yi)滿(man)十(shi)年(nian)(nian)未滿(man)十(shi)五(wu)年(nian)(nian)者(zhe),付(fu)給本(ben)人(ren)工(gong)(gong)資百(bai)分之(zhi)六十(shi);已(yi)滿(man)十(shi)五(wu)年(nian)(nian)及(ji)十(shi)五(wu)年(nian)(nian)以(yi)上(shang)者(zhe),付(fu)給本(ben)人(ren)工(gong)(gong)資百(bai)分之(zhi)七十(shi)。付(fu)至死亡(wang)時(shi)止。
第二十(shi)七(qi)條合于(yu)勞動保險條例第十(shi)五(wu)條養老規(gui)定的(de)工(gong)(gong)人職(zhi)員,因企業需要留(liu)其繼續(xu)工(gong)(gong)作者(zhe),除(chu)工(gong)(gong)資照發外(wai),另由勞動保險基(ji)金項(xiang)下(xia)按月付給(gei)在職(zhi)養老補(bu)助(zhu)費(fei):本(ben)(ben)企業工(gong)(gong)齡已滿(man)(man)五(wu)年(nian)不(bu)滿(man)(man)十(shi)年(nian)者(zhe),付給(gei)本(ben)(ben)人工(gong)(gong)資百(bai)分(fen)之十(shi);已滿(man)(man)十(shi)年(nian)不(bu)滿(man)(man)十(shi)五(wu)年(nian)者(zhe),付給(gei)本(ben)(ben)人工(gong)(gong)資百(bai)分(fen)之十(shi)五(wu);已滿(man)(man)十(shi)五(wu)年(nian)及十(shi)五(wu)年(nian)以(yi)上者(zhe),付給(gei)本(ben)(ben)人工(gong)(gong)資百(bai)分(fen)之二十(shi)。
第(di)二十八條領取(qu)在職(zhi)養老補助費的(de)工人職(zhi)員,退職(zhi)養老時,其在職(zhi)養老補助費,不應計算(suan)在本人工資之內。
第二十(shi)九條(tiao)工(gong)人職員如曾從事(shi)井下礦工(gong)或固(gu)定在華(hua)氏三十(shi)二度以(yi)下低溫(wen)工(gong)作(zuo)場所或華(hua)氏一百度以(yi)上高溫(wen)工(gong)作(zuo)場所的工(gong)作(zuo)時(shi)間(jian),前后合計達十(shi)年,或直接從事(shi)鉛、汞、砒、磷、酸及其他化學、兵工(gong)工(gong)業(ye)的有(you)害(hai)身體健康工(gong)作(zuo)時(shi)間(jian),前后合計達八年,現雖未(wei)從事(shi)上述各項工(gong)作(zuo),仍得按勞動保險條(tiao)例第十(shi)五條(tiao)丙、丁兩款的規定,享(xiang)受退職養老(lao)待(dai)遇。
第(di)三十條工(gong)(gong)人職(zhi)員在該(gai)企(qi)業實行勞動保險(xian)后,由(you)于年(nian)老力衰調動工(gong)(gong)作,其(qi)工(gong)(gong)資降低至該(gai)企(qi)業的平均工(gong)(gong)資以下者,在退(tui)職(zhi)養(yang)老時,其(qi)退(tui)職(zhi)養(yang)老補助費,應按該(gai)企(qi)業的平均工(gong)(gong)資計算。
第八章關于生育待遇的規定
第三十一條勞動保險條例第十六條規定的產假(不(bu)論正產或小(xiao)產),應包括星(xing)期日及法定假(jia)日在內,不(bu)再補假(jia)。
第(di)三十二條女(nv)工(gong)人(ren)(ren)女(nv)職(zhi)員或男工(gong)人(ren)(ren)男職(zhi)員之妻(qi)生育(yu),如(ru)系(xi)雙生或多生時,其生育(yu)補助(zhu)費應按其所生子女(nv)人(ren)(ren)數,每人(ren)(ren)發(fa)給八(ba)萬(wan)元(yuan)萬(wan)元(yuan)為舊(jiu)幣。
第三十(shi)三條夫妻(qi)同在一(yi)個(ge)或分別在兩個(ge)實(shi)行(xing)勞動保險的企業(ye)內工作者(zhe),生育補(bu)助費應(ying)由妻(qi)領取,其夫不(bu)得重領。
第三(san)十(shi)(shi)四條女(nv)(nv)工人(ren)女(nv)(nv)職員懷孕不滿七(qi)個月小產(chan)的產(chan)假,為(wei)(wei)三(san)十(shi)(shi)日以內,但最少(shao)應為(wei)(wei)二十(shi)(shi)日。
第(di)三十五條女工人女職員(yuan)生育,如該企(qi)業醫療所(suo)、醫院、特約醫院、特約醫師無法接生時,其接生費用(yong),亦(yi)由企(qi)業行政方(fang)面或資方(fang)負擔(dan)。
第九章關于臨時工、季節工及試用人員勞動保險待遇的規定
第三十六條(tiao)實(shi)行勞(lao)動(dong)保險的企業的臨時工、季(ji)節工及試用(yong)人(ren)員,其勞(lao)動(dong)保險待(dai)遇暫定為下列各項:
一(yi)、因(yin)(yin)工(gong)(gong)(gong)負(fu)傷醫(yi)(yi)療期間待遇與一(yi)般工(gong)(gong)(gong)人職員同。因(yin)(yin)工(gong)(gong)(gong)負(fu)傷醫(yi)(yi)療終結,確定為殘廢后完全(quan)喪失勞動(dong)力(li)(li)而退職者,由(you)勞動(dong)保險(xian)基金項下,一(yi)次付(fu)給因(yin)(yin)工(gong)(gong)(gong)殘廢撫恤費,其數額為本(ben)人工(gong)(gong)(gong)資(zi)(zi)十二個月;部分(fen)(fen)喪失勞動(dong)力(li)(li)尚能工(gong)(gong)(gong)作者,由(you)企業行政(zheng)方(fang)(fang)面或資(zi)(zi)方(fang)(fang)分(fen)(fen)配適當工(gong)(gong)(gong)作。
二、患病或(huo)非(fei)因(yin)工(gong)(gong)(gong)負傷的醫療(liao)期間以三(san)個月為限(xian),其(qi)醫療(liao)待(dai)遇與一般工(gong)(gong)(gong)人職員同。停工(gong)(gong)(gong)醫療(liao)期間,在(zai)三(san)個月以內者,由(you)企(qi)業行(xing)政方面或(huo)資(zi)(zi)(zi)方按月發給病傷假期工(gong)(gong)(gong)資(zi)(zi)(zi),其(qi)數額為本人工(gong)(gong)(gong)資(zi)(zi)(zi)百分之五十;滿三(san)個月尚未痊愈(yu)者,由(you)勞動保險基金項(xiang)下一次付(fu)給本人工(gong)(gong)(gong)資(zi)(zi)(zi)三(san)個月的疾(ji)病或(huo)非(fei)因(yin)工(gong)(gong)(gong)負傷救濟(ji)費(fei)。
三(san)、因工(gong)(gong)死亡時,由(you)企業行政方(fang)(fang)面或(huo)資(zi)(zi)方(fang)(fang)發(fa)(fa)(fa)給喪葬(zang)費(fei),其(qi)數(shu)額(e)為(wei)本(ben)企業的平均工(gong)(gong)資(zi)(zi)三(san)個(ge)(ge)月(yue)(yue)(yue);另由(you)勞動保險基金項下一次付(fu)給供養(yang)直(zhi)系(xi)親(qin)屬(shu)撫恤費(fei):其(qi)供養(yang)直(zhi)系(xi)親(qin)屬(shu)一人者(zhe),發(fa)(fa)(fa)給本(ben)人工(gong)(gong)資(zi)(zi)六個(ge)(ge)月(yue)(yue)(yue);二人者(zhe),發(fa)(fa)(fa)給本(ben)人工(gong)(gong)資(zi)(zi)九個(ge)(ge)月(yue)(yue)(yue);三(san)人或(huo)三(san)人以上者(zhe),發(fa)(fa)(fa)給本(ben)人工(gong)(gong)資(zi)(zi)十二個(ge)(ge)月(yue)(yue)(yue)。
四、疾病(bing)或(huo)非因工(gong)負傷死亡時(shi),由勞動保(bao)險基金(jin)項(xiang)下(xia)付(fu)給(gei)喪葬補助費,其數額為本企業的(de)平均工(gong)資兩(liang)個(ge)月(yue);另由勞動保(bao)險基金(jin)項(xiang)下(xia)一次(ci)付(fu)給(gei)供養(yang)直(zhi)系親屬救(jiu)濟費,其數額為本人工(gong)資三(san)個(ge)月(yue)。
五、懷(huai)(huai)孕及生育的女(nv)工(gong)人、女(nv)職員,其(qi)懷(huai)(huai)孕檢查費、接生費、生育補助(zhu)費及生育假期與一般女(nv)工(gong)人、女(nv)職員同;產假期間由企業行政(zheng)方面或資方發給產假工(gong)資,其(qi)數額為本人工(gong)資百分之(zhi)六十。
第(di)三(san)十七條在本(ben)細則(ze)公布前,各企業(ye)或(huo)所(suo)屬產業(ye)或(huo)行業(ye)原定有關臨時(shi)工、季節工及(ji)試用人員勞動(dong)保險待(dai)遇的標準高(gao)于本(ben)細則(ze)第(di)三(san)十六條的規定者(zhe),可仍按原規定支付。
第十章關于工齡的規定
第三十八條一般工齡(ling)系指工人職員(yuan)以工資收(shou)入為生活資料之全部(bu)或主要來源(yuan)的(de)工作時間而言。在(zai)計算一般工齡(ling)時,應包(bao)括(kuo)本企業(ye)工齡(ling)在(zai)內(nei)。
第(di)三十(shi)九條本企(qi)業(ye)工齡應以工人職(zhi)員在本企(qi)業(ye)連續工作的時間計算之(zhi),如曾(ceng)離職(zhi),應自最后一次(ci)回(hui)本企(qi)業(ye)工作之(zhi)日算起。但有下列情況之(zhi)一者,不(bu)在此限:
一、凡經(jing)企(qi)業(ye)(ye)管(guan)理機關(guan)、企(qi)業(ye)(ye)行政方(fang)(fang)面(mian)或資(zi)方(fang)(fang)調動(dong)工(gong)作(zuo)者,其調動(dong)前后(hou)的本企(qi)業(ye)(ye)工(gong)齡,均應連續(xu)計(ji)算(suan)。但解放前確因(yin)業(ye)(ye)務需要調動(dong)工(gong)作(zuo)具(ju)有確實證明者,其本企(qi)業(ye)(ye)工(gong)齡,始得連續(xu)計(ji)算(suan)。
二、解放前在本企(qi)(qi)業工作(zuo),曾經被迫離職又回(hui)本企(qi)(qi)業工作(zuo)者,如(ru)有確實證明,經工會小組討論(lun)通過(guo)后(hou)(hou),并(bing)經勞動保險委員會批準,其(qi)離職前與回(hui)本企(qi)(qi)業后(hou)(hou)的工作(zuo)時(shi)間(jian),可合并(bing)作(zuo)本企(qi)(qi)業工齡(ling)計算(suan)。
三、解放(fang)后(hou)經企業(ye)管理(li)機關、企業(ye)行政方(fang)面(mian)或資方(fang)調(diao)派國(guo)內(nei)外學(xue)(xue)習(xi)者(zhe)(zhe),其學(xue)(xue)習(xi)期間及調(diao)派前后(hou)的本企業(ye)工齡,應(ying)連續(xu)計算。解放(fang)前經企業(ye)管理(li)機關、企業(ye)行政方(fang)面(mian)或資方(fang)調(diao)派國(guo)內(nei)外學(xue)(xue)習(xi)業(ye)務(wu)者(zhe)(zhe),如有確實證明,除學(xue)(xue)習(xi)期間不(bu)計工齡外,其調(diao)派前與(yu)回本企業(ye)后(hou)的本企業(ye)工齡,得(de)合并計算。
四、解放后(hou)(hou)因企(qi)(qi)業(ye)停工(gong)(gong)(gong)(gong)(gong)歇業(ye)或(huo)縮減生產,其(qi)工(gong)(gong)(gong)(gong)(gong)人職(zhi)(zhi)員(yuan)經企(qi)(qi)業(ye)管理機(ji)關(guan)調派(pai)至其(qi)他企(qi)(qi)業(ye)工(gong)(gong)(gong)(gong)(gong)作者(zhe),其(qi)調派(pai)前(qian)后(hou)(hou)的本(ben)企(qi)(qi)業(ye)工(gong)(gong)(gong)(gong)(gong)齡(ling)(ling),應連續(xu)計算。被(bei)遣(qian)散的工(gong)(gong)(gong)(gong)(gong)人職(zhi)(zhi)員(yuan)在該(gai)企(qi)(qi)業(ye)復工(gong)(gong)(gong)(gong)(gong)復業(ye)或(huo)擴大(da)生產時,仍回本(ben)企(qi)(qi)業(ye)工(gong)(gong)(gong)(gong)(gong)作者(zhe),其(qi)遣(qian)散前(qian)與(yu)復工(gong)(gong)(gong)(gong)(gong)后(hou)(hou)的本(ben)企(qi)(qi)業(ye)工(gong)(gong)(gong)(gong)(gong)齡(ling)(ling),應合并計算。
五(wu)、企業(ye)(ye)經(jing)轉讓(rang)、改(gai)組或(huo)合(he)并,原有工人(ren)職員仍(reng)留企業(ye)(ye)工作者,其(qi)轉讓(rang)、改(gai)組或(huo)合(he)并前后(hou)的本企業(ye)(ye)工齡,應(ying)連(lian)續計算。
六、因工(gong)(gong)負(fu)傷停止工(gong)(gong)作醫療期間,應(ying)全部作為本企業工(gong)(gong)齡計算。
七、疾病或非因工負傷停止工作(zuo)醫療期間,在六(liu)個月(yue)以內(nei)者(zhe),得(de)連續(xu)作(zuo)本企(qi)業工齡(ling)計算(suan);超過(guo)六(liu)個月(yue)病愈后,仍回(hui)原企(qi)業工作(zuo)者(zhe),除(chu)超過(guo)六(liu)個月(yue)的期間不算(suan)工齡(ling)外,其前后本企(qi)業工齡(ling),應合并計算(suan)。
八、在敵偽及(ji)(ji)國民黨反(fan)動統治下為反(fan)對其(qi)(qi)統治壓迫(po)而(er)被迫(po)離職,在離職期間(jian)被敵偽及(ji)(ji)國民黨政府監(jian)禁仍繼續(xu)斗(dou)爭者,其(qi)(qi)在監(jian)禁期間(jian)及(ji)(ji)離職前與(yu)復職后(hou)或轉入(ru)其(qi)(qi)他企業工(gong)作的本企業工(gong)齡,均應連續(xu)計算。
第四十條轉入企業工(gong)作(zuo)的專(zhuan)門從(cong)事(shi)革(ge)命(ming)工(gong)作(zuo)者及革(ge)命(ming)軍人,其從(cong)事(shi)革(ge)命(ming)工(gong)作(zuo)的年限及軍齡(ling),均(jun)應作(zuo)本企業工(gong)齡(ling)計算。
第四十(shi)一(yi)條凡工(gong)(gong)人職(zhi)員在敵偽及國民黨反動(dong)統治時期,充任下列職(zhi)務之一(yi)者,其從事該項職(zhi)務的時間(jian),一(yi)律不作工(gong)(gong)齡計(ji)算:
一、把頭、監工、廠(chang)警、礦警等(deng)有壓迫剝削行為(wei)者。
二、敵(di)偽及國民(min)黨(dang)軍隊(dui)憲兵中的(de)官兵,警察(cha)(cha)中的(de)警官警察(cha)(cha),敵(di)偽及國民(min)黨(dang)政府機(ji)關中的(de)官吏,但不包(bao)括企業(ye)機(ji)關中的(de)人員(yuan)。
三(san)(san)、國民(min)黨(dang)區分部(bu)委(wei)員(yuan)以(yi)上,三(san)(san)民(min)主義青年(nian)團分隊長以(yi)上,青年(nian)黨(dang)區黨(dang)部(bu)委(wei)員(yuan)以(yi)上及民(min)主社(she)會黨(dang)區支部(bu)委(wei)員(yuan)以(yi)上的人(ren)員(yuan),反動道會門主要(yao)負(fu)責人(ren)。
第四十二(er)條凡被剝(bo)(bo)奪政(zheng)治(zhi)(zhi)權利者,其(qi)被剝(bo)(bo)奪政(zheng)治(zhi)(zhi)權利期間,不作(zuo)工(gong)(gong)齡(ling)(ling)計算。因反革(ge)命罪(zui)行而(er)被剝(bo)(bo)奪政(zheng)治(zhi)(zhi)權利者,其(qi)本企業工(gong)(gong)齡(ling)(ling),應自恢復(fu)政(zheng)治(zhi)(zhi)權利之(zhi)日算起;因其(qi)他(ta)犯罪(zui)行為而(er)被剝(bo)(bo)奪政(zheng)治(zhi)(zhi)權利者,其(qi)被剝(bo)(bo)奪政(zheng)治(zhi)(zhi)權利前與恢復(fu)政(zheng)治(zhi)(zhi)權利后的本企業工(gong)(gong)齡(ling)(ling),應合并計算。
第四(si)十(shi)三條勞動(dong)保險(xian)條例第十(shi)五條丙、丁(ding)兩款(kuan)關于折(zhe)算一般工齡(ling)及本企業工齡(ling)的規定,在計算各項(xiang)勞動(dong)保險(xian)待遇時,均(jun)同樣適(shi)用。
第四十四條(tiao)學徒(tu)在本(ben)企業(ye)學習期間,應作本(ben)企業(ye)工齡計算,臨時工、試(shi)用人員(yuan)轉(zhuan)為正式工人職員(yuan)時,其本(ben)企業(ye)工齡,應自入(ru)該企業(ye)工作之日算起。
第十一章關于供養直系親屬的規定
第四十五條(tiao)工(gong)人職(zhi)(zhi)(zhi)員(yuan)的直系(xi)親(qin)屬,其主要(yao)生活來源,系(xi)依靠工(gong)人職(zhi)(zhi)(zhi)員(yuan)供(gong)給,并合于下列各款規定之一(yi)者,均得列為該工(gong)人職(zhi)(zhi)(zhi)員(yuan)的供(gong)養直系(xi)親(qin)屬,享受勞動保險待遇(yu):
一、祖父(fu)、父(fu)、夫(fu)年滿六(liu)十歲或完(wan)全喪失勞動力(li)者(zhe);
二、祖(zu)母、母、妻未從事有(you)報酬的工作者;
三、子女(包括(kuo)養子(zi)女(nv)(nv)(nv),前妻或前夫(fu)所生(sheng)子(zi)女(nv)(nv)(nv),非婚(hun)生(sheng)子(zi)女(nv)(nv)(nv))、弟妹(mei)(包括同父異母或同母異父的弟妹)年未滿十六歲(sui);
四、孫子女年(nian)未(wei)滿(man)十(shi)六歲,其父(fu)死亡(wang)或完全喪失勞動力,母未(wei)從事有報酬(chou)的工作(zuo)者。
第四十六(liu)條工(gong)人職員自(zi)幼依(yi)靠他(ta)人撫(fu)養長大,現撫(fu)養人男(nan)年(nian)滿六(liu)十歲或(huo)完全喪失勞(lao)動力,女未從事有報(bao)酬(chou)的工(gong)作,須依(yi)靠工(gong)人職員本人供養且共同居住者,得(de)以供養直系親屬論。
第(di)四十七條工(gong)人職員(yuan)因工(gong)死亡(wang)后,其遺腹子得列為(wei)供養直系(xi)親屬。
第四十八條(tiao)工(gong)(gong)人職(zhi)員的供養直系(xi)親屬(shu),如(ru)不與工(gong)(gong)人職(zhi)員同在一處(chu)居住,須取得其所在地政府機(ji)關證明,確系(xi)依靠工(gong)(gong)人職(zhi)員供養,方得列為供養直系(xi)親屬(shu)。
第十二章關于醫療機構的規定
第四(si)十九(jiu)條實行勞動(dong)保(bao)險的企(qi)業(ye),已設立醫(yi)療(liao)機(ji)構者(zhe),應根據必要與可(ke)能(neng)的情況,充實設備,并應建(jian)立健全制度;未建(jian)立醫(yi)療(liao)機(ji)構者(zhe),應單獨(du)或(huo)聯合設立醫(yi)療(liao)所或(huo)醫(yi)院;如因(yin)條件(jian)限制不能(neng)設立,應有(you)特(te)(te)約醫(yi)院或(huo)特(te)(te)約中西醫(yi)師(shi),為病傷工人職員(yuan)負責醫(yi)治。所有(you)有(you)關醫(yi)療(liao)所、醫(yi)院、特(te)(te)約醫(yi)院、特(te)(te)約中西醫(yi)師(shi)的一切費用(yong),均由(you)企(qi)業(ye)行政方面或(huo)資方負擔。
第十三章關于療養所、業余療養所、托兒所的規定
第五十條實行(xing)(xing)勞動(dong)保險(xian)的(de)企(qi)業,應根據工人職員的(de)需要及企(qi)業經濟(ji)情況,單(dan)獨或(huo)(huo)聯(lian)合其(qi)他企(qi)業設立療(liao)(liao)(liao)養(yang)(yang)所(suo)(suo)、業余療(liao)(liao)(liao)養(yang)(yang)所(suo)(suo)、營(ying)養(yang)(yang)食(shi)堂(tang)。療(liao)(liao)(liao)養(yang)(yang)所(suo)(suo)、業余療(liao)(liao)(liao)養(yang)(yang)所(suo)(suo)、營(ying)養(yang)(yang)食(shi)堂(tang)的(de)房屋設備、工作人員的(de)工資及一(yi)切(qie)經常費用,完全由企(qi)業行(xing)(xing)政方面或(huo)(huo)資方負擔。休(xiu)養(yang)(yang)員及營(ying)養(yang)(yang)員的(de)伙(huo)(huo)食(shi)費,在勞動(dong)保險(xian)基(ji)金支付各項補助費、救濟(ji)費、撫(fu)恤費后有剩余時得(de)給予補助,最多不得(de)超過伙(huo)(huo)食(shi)費的(de)二分之一(yi),如因身(shen)體衰弱或(huo)(huo)經濟(ji)確實困難負擔不起伙(huo)(huo)食(shi)費者(zhe),得(de)酌量提高(gao)其(qi)補助費,但不得(de)超過伙(huo)(huo)食(shi)費的(de)三分之二。各企(qi)業工會基(ji)層委員會,應按(an)期編制伙(huo)(huo)食(shi)補助費的(de)預算,送掌(zhang)管調劑金的(de)上級工會組織批準后執(zhi)行(xing)(xing)。
第五十一條實行勞動保險的企業的女工人女職員,有四周歲以內的子女二十人以上,工會基層委員會與企業行政方面或資方協商單獨或聯合其他企業設立托兒所(如尚未具(ju)備設立托兒(er)所條件,而有哺乳嬰兒(er)五個(ge)以(yi)上時,須設立哺乳室)。其房屋設備、工(gong)作(zuo)人員的工(gong)資(zi)及一切(qie)經常費用,完全由企業行政(zheng)方(fang)面(mian)或資(zi)方(fang)負(fu)擔,托兒(er)飲食費由托兒(er)父母(mu)負(fu)擔,如托兒(er)父母(mu)經濟確有困難(nan)者(zhe),得由勞動保險基金項下予以補助,但對每個兒(er)童的補助不得超過托兒(er)飲食費的三分之一。
第十四章關于優異勞動保險待遇的規定
第五(wu)十二條(tiao)(tiao)合于勞(lao)動(dong)(dong)保(bao)險(xian)條(tiao)(tiao)例第十九條(tiao)(tiao)的規(gui)定,享受(shou)優異勞(lao)動(dong)(dong)保(bao)險(xian)待遇的工(gong)人(ren)(ren)職員因工(gong)死(si)亡時,其(qi)(qi)供養(yang)直(zhi)系(xi)親屬撫恤費,依(yi)下(xia)列規(gui)定由勞(lao)動(dong)(dong)保(bao)險(xian)基金項(xiang)下(xia)按月付(fu)給:其(qi)(qi)供養(yang)直(zhi)系(xi)親屬一人(ren)(ren)者(zhe)(zhe),為(wei)死(si)者(zhe)(zhe)本人(ren)(ren)工(gong)資(zi)(zi)百(bai)分之三十;二人(ren)(ren)者(zhe)(zhe),為(wei)死(si)者(zhe)(zhe)本人(ren)(ren)工(gong)資(zi)(zi)百(bai)分之四(si)十五(wu),三人(ren)(ren)及三人(ren)(ren)以(yi)上者(zhe)(zhe),為(wei)死(si)者(zhe)(zhe)本人(ren)(ren)工(gong)資(zi)(zi)百(bai)分之六十。此項(xiang)撫恤費付(fu)至受(shou)供養(yang)者(zhe)(zhe)失去受(shou)供養(yang)的條(tiao)(tiao)件時止。
第五十(shi)(shi)(shi)(shi)(shi)三(san)條(tiao)合于勞動(dong)(dong)保(bao)(bao)險(xian)條(tiao)例(li)第十(shi)(shi)(shi)(shi)(shi)九條(tiao)的(de)規定,享(xiang)受優異勞動(dong)(dong)保(bao)(bao)險(xian)待遇的(de)工(gong)(gong)(gong)人(ren)(ren)(ren)職員退職養老(lao)(lao)時,按(an)月(yue)付(fu)給退職養老(lao)(lao)補(bu)助(zhu)費:本(ben)企業(ye)工(gong)(gong)(gong)齡已滿(man)(man)五年(nian)(nian)(nian)未滿(man)(man)十(shi)(shi)(shi)(shi)(shi)年(nian)(nian)(nian)者(zhe),為本(ben)人(ren)(ren)(ren)工(gong)(gong)(gong)資百(bai)分(fen)(fen)之六十(shi)(shi)(shi)(shi)(shi);已滿(man)(man)十(shi)(shi)(shi)(shi)(shi)年(nian)(nian)(nian)未滿(man)(man)十(shi)(shi)(shi)(shi)(shi)五年(nian)(nian)(nian)者(zhe),為本(ben)人(ren)(ren)(ren)工(gong)(gong)(gong)資百(bai)分(fen)(fen)之七(qi)十(shi)(shi)(shi)(shi)(shi);已滿(man)(man)十(shi)(shi)(shi)(shi)(shi)五年(nian)(nian)(nian)及十(shi)(shi)(shi)(shi)(shi)五年(nian)(nian)(nian)以上(shang)者(zhe),為本(ben)人(ren)(ren)(ren)工(gong)(gong)(gong)資百(bai)分(fen)(fen)之八十(shi)(shi)(shi)(shi)(shi)。此(ci)項補(bu)助(zhu)費付(fu)至死亡時止。合于養老(lao)(lao)規定的(de)工(gong)(gong)(gong)人(ren)(ren)(ren)職員,因企業(ye)工(gong)(gong)(gong)作需要,留其繼續工(gong)(gong)(gong)作時,除工(gong)(gong)(gong)資照發外,另(ling)由勞動(dong)(dong)保(bao)(bao)險(xian)基金(jin)項下,按(an)月(yue)付(fu)給在(zai)職養老(lao)(lao)補(bu)助(zhu)費:本(ben)企業(ye)工(gong)(gong)(gong)齡已滿(man)(man)五年(nian)(nian)(nian)未滿(man)(man)十(shi)(shi)(shi)(shi)(shi)年(nian)(nian)(nian)者(zhe),為本(ben)人(ren)(ren)(ren)工(gong)(gong)(gong)資百(bai)分(fen)(fen)之二(er)十(shi)(shi)(shi)(shi)(shi);已滿(man)(man)十(shi)(shi)(shi)(shi)(shi)年(nian)(nian)(nian)未滿(man)(man)十(shi)(shi)(shi)(shi)(shi)五年(nian)(nian)(nian)者(zhe),為本(ben)人(ren)(ren)(ren)工(gong)(gong)(gong)資百(bai)分(fen)(fen)之二(er)十(shi)(shi)(shi)(shi)(shi)五;已滿(man)(man)十(shi)(shi)(shi)(shi)(shi)五年(nian)(nian)(nian)及十(shi)(shi)(shi)(shi)(shi)五年(nian)(nian)(nian)以上(shang)者(zhe),為本(ben)人(ren)(ren)(ren)工(gong)(gong)(gong)資百(bai)分(fen)(fen)之三(san)十(shi)(shi)(shi)(shi)(shi)。此(ci)項補(bu)助(zhu)費付(fu)至退職養老(lao)(lao)或(huo)死亡時止。
第十五章關于勞動保險各項費用申請與支付手續的規定
第五十四條(tiao)凡(fan)在勞動保險基金項(xiang)下支付的各項(xiang)撫恤(xu)費、補助費與救濟費,均由工人(ren)職員或供養直(zhi)系親(qin)屬向勞動保險委員會申請(qing)領取,其程序(xu)規定如下:
一、開始申(shen)請(qing)(qing)時,應據實填(tian)寫(xie)申(shen)請(qing)(qing)書,如需證明,應將證明文(wen)件(jian)一并(bing)提交工會小組(zu)勞動保(bao)險干(gan)事或(huo)工會小組(zu)長(chang)召開小組(zu)會議討(tao)論,審(shen)查所填(tian)各項是否屬實,并(bing)將審(shen)查意(yi)見填(tian)入申(shen)請(qing)(qing)書“工會小組(zu)意(yi)見”欄內,簽名蓋章后,送交勞動保(bao)險委員會。
二、勞動保險委員會接到申請書,查對勞動保險登記卡片后,由勞動保險委員會主任(必要(yao)時可召開勞(lao)動保(bao)險委員會討論)在申請(qing)書(shu)上批(pi)準(zhun)(zhun)(zhun)應(ying)(ying)享(xiang)受(shou)的勞動保險(xian)待(dai)遇及其計算(suan)標(biao)準(zhun)(zhun)(zhun),并(bing)填(tian)具付款(kuan)憑(ping)單,連(lian)同申請(qing)書(shu)一并(bing)交(jiao)由申請(qing)人(ren)持往勞動保險(xian)會計處取(qu)款(kuan),如系按月領(ling)取(qu)者,應(ying)(ying)于批(pi)準(zhun)(zhun)(zhun)申請(qing)書(shu)時發給領(ling)取(qu)證。事(shi)后須(xu)在勞動保險(xian)委員會定(ding)期(qi)會議上匯(hui)報。
三、勞(lao)(lao)(lao)動(dong)保(bao)險(xian)委員會,根據工作需(xu)要,可授(shou)權車間勞(lao)(lao)(lao)動(dong)保(bao)險(xian)委員會,依(yi)照勞(lao)(lao)(lao)動(dong)保(bao)險(xian)條(tiao)例及其實(shi)施(shi)細則的規定(ding),審查批(pi)準工人(ren)職(zhi)員的勞(lao)(lao)(lao)動(dong)保(bao)險(xian)待遇(yu)。
四、勞(lao)動(dong)保(bao)險(xian)會(hui)計付(fu)款后,應(ying)在申(shen)請書(shu)上注(zhu)明支付(fu)金額及(ji)日期,簽(qian)名蓋章,并將(jiang)申(shen)請書(shu)退還勞(lao)動(dong)保(bao)險(xian)委員會(hui)負責保(bao)管(guan)。
五、按月領(ling)取勞(lao)(lao)動(dong)保(bao)(bao)險(xian)(xian)待(dai)遇者,應在(zai)(zai)(zai)每月領(ling)款(kuan)(kuan)前,將領(ling)取證(zheng)(zheng)送(song)經勞(lao)(lao)動(dong)保(bao)(bao)險(xian)(xian)委(wei)員(yuan)會主(zhu)任(ren)簽名或蓋(gai)章并(bing)(bing)填(tian)具付(fu)款(kuan)(kuan)單后(hou),持往勞(lao)(lao)動(dong)保(bao)(bao)險(xian)(xian)會計(ji)處(chu)領(ling)款(kuan)(kuan),如其(qi)本人(ren)或供(gong)養直系親屬不在(zai)(zai)(zai)當地,須附所在(zai)(zai)(zai)地政府機關開具的證(zheng)(zheng)明文件(jian),連(lian)同領(ling)取證(zheng)(zheng)一并(bing)(bing)寄交勞(lao)(lao)動(dong)保(bao)(bao)險(xian)(xian)委(wei)員(yuan)會申請匯(hui)付(fu),其(qi)匯(hui)費及(ji)郵費,均(jun)由勞(lao)(lao)動(dong)保(bao)(bao)險(xian)(xian)基(ji)金項(xiang)下支付(fu)。
第五十五條勞動保險委員會付給的撫恤費、補助費、救濟費,按月付給者,至遲應于每月月底付給,如領款人不在當地居住,勞動保險委員會可按季度付給(三個月付一次)。一(yi)次發給(gei)者,至(zhi)遲應于批準后五日內發給(gei)。
第五十六條由企業行政方(fang)面或資方(fang)直接支(zhi)(zhi)付(fu)(fu)的病傷、生育假期工資及因工死亡喪葬費(fei)(fei),于每月發放后,應將領款人姓名、支(zhi)(zhi)付(fu)(fu)標準、支(zhi)(zhi)付(fu)(fu)金額按(an)費(fei)(fei)別造表(biao),送交勞動保(bao)險委(wei)員(yuan)會(hui)備(bei)查。
第五十(shi)七(qi)條因工(gong)死(si)亡喪葬費(fei)(fei)、非因工(gong)死(si)亡喪葬補助(zhu)費(fei)(fei),由死(si)者供(gong)養(yang)直(zhi)系親(qin)屬(shu)或直(zhi)系親(qin)屬(shu)申請領取,如無上述親(qin)屬(shu)或親(qin)屬(shu)不在(zai)當地,得由工(gong)會(hui)基層委員會(hui)代為領取,負(fu)責辦理喪葬事宜(yi)。
第五十八條(tiao)凡實行勞動(dong)保(bao)險的企(qi)(qi)業,如遷(qian)移(yi)至(zhi)其(qi)他(ta)地區,其(qi)不能(neng)隨(sui)企(qi)(qi)業遷(qian)移(yi)的工人職員(yuan)(yuan)按(an)(an)月領取的撫恤費(fei)、補助費(fei)與(yu)救濟費(fei),由省市工會或產業工會全國(guo)委員(yuan)(yuan)會在調(diao)劑(ji)金(jin)中繼續支付(fu);工人職員(yuan)(yuan)病(bing)傷尚(shang)未痊愈者,應繼續予以治(zhi)療,由企(qi)(qi)業行政方面或資(zi)方按(an)(an)照(zhao)勞動(dong)保(bao)險條(tiao)例第十二條(tiao)甲款(kuan)或第十三條(tiao)甲、乙兩款(kuan)的規(gui)定(ding),匯發醫藥(yao)費(fei)及醫療期間工資(zi)。
第五(wu)十(shi)九條凡實行勞動保(bao)險的(de)企(qi)業(ye)(ye)(ye)歇業(ye)(ye)(ye)時(shi),其工(gong)(gong)(gong)人(ren)職員按月領(ling)取的(de)撫恤費、補助費與救濟費,由省市工(gong)(gong)(gong)會(hui)(hui)或產業(ye)(ye)(ye)工(gong)(gong)(gong)會(hui)(hui)全國(guo)委(wei)員會(hui)(hui)在調(diao)劑金中繼(ji)續支付;工(gong)(gong)(gong)人(ren)職員病傷(shang)尚未痊(quan)愈者,應在歇業(ye)(ye)(ye)時(shi),由企(qi)業(ye)(ye)(ye)行政方(fang)面或資方(fang)與工(gong)(gong)(gong)會(hui)(hui)基(ji)層委(wei)員會(hui)(hui)協(xie)商(shang)處理之(zhi)。
第六(liu)十條凡(fan)實行勞動保(bao)險(xian)的企業(ye),如經(jing)轉讓、改組(zu)或合(he)并,其全(quan)部勞動保(bao)險(xian)業(ye)務(wu),應由(you)接(jie)辦者繼(ji)續辦理,所有對(dui)工人職員應繼(ji)續支付的各項勞動保(bao)險(xian)費用,不得中(zhong)止(zhi)付給。
第六十一條(tiao)領(ling)取(qu)撫恤費(fei)、補(bu)助費(fei)與救濟費(fei)的工人職員或(huo)供養直系親屬,如被(bei)剝奪政治權利,應即停(ting)止發給,政治權利恢(hui)復時,經其本人提出證明,送請勞(lao)動保險委員會批準,仍得繼續領(ling)取(qu),但(dan)停(ting)發期(qi)間的勞(lao)動保險待遇,不予(yu)補(bu)發。
第六(liu)十二條在(zai)實(shi)(shi)行勞動(dong)(dong)保(bao)(bao)(bao)險(xian)的(de)企(qi)業(ye)(ye)內(nei)(nei)工(gong)作(zuo)的(de)工(gong)人職員,經(jing)企(qi)業(ye)(ye)管理機關調(diao)至其(qi)他實(shi)(shi)行勞動(dong)(dong)保(bao)(bao)(bao)險(xian)的(de)企(qi)業(ye)(ye)內(nei)(nei)工(gong)作(zuo)時,由(you)勞動(dong)(dong)保(bao)(bao)(bao)險(xian)委員會(hui)將勞動(dong)(dong)保(bao)(bao)(bao)險(xian)登記卡片及有關勞動(dong)(dong)保(bao)(bao)(bao)險(xian)文件寄交(jiao)調(diao)用企(qi)業(ye)(ye),勞動(dong)(dong)保(bao)(bao)(bao)險(xian)委員會(hui)于工(gong)人職員到達(da)后(hou)辦(ban)理登記,繼續享受勞動(dong)(dong)保(bao)(bao)(bao)險(xian)待遇(yu)。如(ru)在(zai)調(diao)用途中發生病、傷(shang)、殘廢或死亡(wang)時,應(ying)(ying)由(you)調(diao)用企(qi)業(ye)(ye)按(an)照(zhao)勞動(dong)(dong)保(bao)(bao)(bao)險(xian)條例的(de)規(gui)定辦(ban)理。至于由(you)已實(shi)(shi)行勞動(dong)(dong)保(bao)(bao)(bao)險(xian)的(de)企(qi)業(ye)(ye)調(diao)到未(wei)實(shi)(shi)行勞動(dong)(dong)保(bao)(bao)(bao)險(xian)的(de)企(qi)業(ye)(ye)內(nei)(nei)工(gong)作(zuo)時,其(qi)有關勞動(dong)(dong)保(bao)(bao)(bao)險(xian)待遇(yu)事項,應(ying)(ying)按(an)調(diao)用單位(wei)的(de)現有規(gui)定辦(ban)理。
第六十三(san)條(tiao)工人職員(yuan)或其(qi)供養(yang)直(zhi)系親(qin)屬對勞(lao)動保險待遇的(de)決(jue)定、核算及支(zhi)付(fu),與(yu)企業(ye)行(xing)政方面(mian)或資方及勞(lao)動保險委(wei)員(yuan)會有不同意(yi)見時,可提(ti)請上(shang)級工會組織處理,或向當地人民政府勞(lao)動行(xing)政機關提(ti)出(chu)申訴。
第六十(shi)四(si)條領取(qu)(qu)各(ge)項(xiang)撫恤費、補助費與救濟(ji)費的(de)工人職員(yuan)或其供養直(zhi)系親(qin)屬,如其領取(qu)(qu)條件(jian)有變更(geng)或失去(qu)領取(qu)(qu)條件(jian)時(shi),應即報(bao)告勞(lao)動(dong)保(bao)(bao)險(xian)委員(yuan)會(hui)(hui),如有虛報(bao)匿報(bao)情(qing)形時(shi),經查出后,勞(lao)動(dong)保(bao)(bao)險(xian)委員(yuan)會(hui)(hui)得(de)按情(qing)節輕重,給以公開批評或停止享受各(ge)項(xiang)勞(lao)動(dong)保(bao)(bao)險(xian)待遇的(de)權利(li)一(yi)個月(yue)至三個月(yue),并追還匿報(bao)虛報(bao)所領取(qu)(qu)的(de)金額。
第六十五條(tiao)凡按月領取的(de)撫恤費、補助費與救濟(ji)費的(de)計算標準有變動(dong)時,由勞動(dong)保(bao)險委員會在領取證上批注;其(qi)種類有變更時,將原領取證交回注銷,并由申(shen)(shen)請(qing)人另填(tian)申(shen)(shen)請(qing)書申(shen)(shen)請(qing)之。
第十六章關于勞動保險金保管收支的規定
第六十六條屬于(yu)鐵路、郵電、兵工(gong)及海(hai)員(yuan)(yuan)工(gong)會(hui)全國(guo)委(wei)員(yuan)(yuan)會(hui)的(de)工(gong)會(hui)基(ji)層委(wei)員(yuan)(yuan)會(hui),每(mei)月(yue)應將勞(lao)(lao)動保險基(ji)金(jin)(jin)的(de)剩余部分(fen),轉(zhuan)入(ru)各該產業(ye)(ye)工(gong)會(hui)全國(guo)委(wei)員(yuan)(yuan)會(hui)戶內,作為調(diao)劑(ji)金(jin)(jin);不(bu)屬于(yu)上(shang)(shang)述(shu)產業(ye)(ye)工(gong)會(hui)全國(guo)委(wei)員(yuan)(yuan)會(hui)的(de)工(gong)會(hui)基(ji)層委(wei)員(yuan)(yuan)會(hui),每(mei)月(yue)應將勞(lao)(lao)動保險基(ji)金(jin)(jin)的(de)剩余部分(fen),轉(zhuan)入(ru)直屬上(shang)(shang)級的(de)省、市(shi)工(gong)會(hui)組織戶內,作為調(diao)劑(ji)金(jin)(jin)。紡織、煤礦及其他產業(ye)(ye)工(gong)會(hui),如具(ju)備自行(xing)掌管調(diao)劑(ji)金(jin)(jin)的(de)條件時,經中華全國(guo)總(zong)工(gong)會(hui)批準(zhun),即可(ke)自行(xing)掌管調(diao)劑(ji)金(jin)(jin)。
第六十七條(tiao)凡掌管調劑金的(de)產業(ye)工會全國委員會,如授權其地方組織掌管調劑金調用時(shi),應根據各(ge)該產業(ye)的(de)具體情況(kuang),制(zhi)定詳細辦法(fa),報告(gao)中華全國總(zong)工會及(ji)中央人(ren)民政府勞動(dong)部備案。
第(di)六十八條滯納金由(you)工會基(ji)層(ceng)委員會轉入(ru)勞動(dong)(dong)保險基(ji)金項下,其用途與勞動(dong)(dong)保險基(ji)金同(tong)。
第六十九條(tiao)各企(qi)業會(hui)(hui)計部(bu)門(men),應依(yi)照(zhao)勞(lao)動保險(xian)基金會(hui)(hui)計制度的(de)規(gui)定,單獨(du)設立帳簿,記(ji)載勞(lao)動保險(xian)基金的(de)收(shou)支事項。此項工(gong)作(zuo),由企(qi)業會(hui)(hui)計部(bu)門(men)辦理,并對勞(lao)動保險(xian)委員會(hui)(hui)負責。
第(di)七十條各企(qi)業(ye)在開始實行勞(lao)(lao)動(dong)保(bao)(bao)險(xian)時,工(gong)(gong)會(hui)(hui)(hui)基(ji)層委(wei)員會(hui)(hui)(hui),應(ying)按該企(qi)業(ye)實有(you)人數,報告(gao)產業(ye)工(gong)(gong)會(hui)(hui)(hui)全國(guo)委(wei)員會(hui)(hui)(hui)或(huo)省、市工(gong)(gong)會(hui)(hui)(hui)組織(zhi)(zhi),并編制勞(lao)(lao)動(dong)保(bao)(bao)險(xian)登記卡片印制費(fei)預算,報請中華全國(guo)總工(gong)(gong)會(hui)(hui)(hui)核發,由勞(lao)(lao)動(dong)保(bao)(bao)險(xian)總基(ji)金內(nei)支付。工(gong)(gong)會(hui)(hui)(hui)基(ji)層組織(zhi)(zhi)辦(ban)(ban)理勞(lao)(lao)動(dong)保(bao)(bao)險(xian)業(ye)務所需(xu)的(de)(de)(de)申請書(shu)、領取證的(de)(de)(de)紙張(zhang)(zhang)印刷費(fei),應(ying)報請掌管調劑金的(de)(de)(de)省、市工(gong)(gong)會(hui)(hui)(hui)組織(zhi)(zhi)及產業(ye)工(gong)(gong)會(hui)(hui)(hui)全國(guo)委(wei)員會(hui)(hui)(hui)核發,由調劑金內(nei)支付。各級(ji)工(gong)(gong)會(hui)(hui)(hui)組織(zhi)(zhi)所需(xu)的(de)(de)(de)統計(ji)表的(de)(de)(de)紙張(zhang)(zhang)印刷費(fei)、宣傳費(fei)、辦(ban)(ban)公費(fei)及其他(ta)開支,由工(gong)(gong)會(hui)(hui)(hui)工(gong)(gong)作費(fei)內(nei)支付。企(qi)業(ye)會(hui)(hui)(hui)計(ji)部門辦(ban)(ban)理勞(lao)(lao)動(dong)保(bao)(bao)險(xian)基(ji)金會(hui)(hui)(hui)計(ji)人員的(de)(de)(de)工(gong)(gong)資(zi)、辦(ban)(ban)公費(fei)用、傳票、帳簿、報表及其他(ta)經常開支,均由企(qi)業(ye)行政方面或(huo)資(zi)方負擔(dan)。
第十七章關于勞動保險業務的監督與檢查的規定
第(di)(di)(di)七十一條各(ge)大(da)行(xing)政(zheng)(zheng)區(qu)工會(hui)組織(zhi),每(mei)三個月(yue)向所在地大(da)行(xing)政(zheng)(zheng)區(qu)勞動行(xing)政(zheng)(zheng)機關、中央人民政(zheng)(zheng)府勞動部及中華全國總(zong)工會(hui)報送的勞動保險基金收支報告(gao),應(ying)按季度(du)編(bian)造,即以每(mei)年一、二(er)(er)、三月(yue)為第(di)(di)(di)一季度(du),四(si)、五、六月(yue)為第(di)(di)(di)二(er)(er)季度(du),七、八、九月(yue)為第(di)(di)(di)三季度(du),十、十一、十二(er)(er)月(yue)為第(di)(di)(di)四(si)季度(du)。如開(kai)始報告(gao)的月(yue)份(fen)在季度(du)開(kai)始之第(di)(di)(di)二(er)(er)個月(yue)或第(di)(di)(di)三個月(yue)時,亦應(ying)按照本條規(gui)定辦理(li),不得跨季度(du)或年度(du)編(bian)造。
第七十二條經費(fei)審查(cha)委(wei)員會(hui)(hui)對于勞動保險基金收支(zhi)帳目,有隨時審查(cha)之(zhi)權,發現錯(cuo)誤,可立即提出意見,企業(ye)的會(hui)(hui)計(ji)部(bu)門(men)或勞動保險委(wei)員會(hui)(hui)應(ying)迅(xun)速答(da)復或改正(zheng),如(ru)逾(yu)十日仍未答(da)復或處理(li)不當(dang),其錯(cuo)誤系(xi)屬于企業(ye)會(hui)(hui)計(ji)部(bu)門(men)者(zhe),可提請(qing)企業(ye)行政(zheng)方面或資方處理(li),必要(yao)時得提請(qing)當(dang)地人民政(zheng)府勞動行政(zheng)機關(guan)追究;如(ru)錯(cuo)誤系(xi)屬勞動保險委(wei)員會(hui)(hui)者(zhe),得提請(qing)工會(hui)(hui)基層委(wei)員會(hui)(hui)或上級工會(hui)(hui)組(zu)織(zhi)處理(li)之(zhi)。
第(di)七十三條工人(ren)職員(yuan)對勞動保險(xian)基金的收支及企業行政方面(mian)或資方直(zhi)接支付的各(ge)項勞動保險(xian)費用,發現疑問(wen)或錯誤時,可報告工會基層委(wei)員(yuan)會處理(li)(li),如情節重(zhong)大,得(de)越級報告上級工會組織或當地人(ren)民政府勞動行政機關(guan)處理(li)(li)之。
第七十四條各企(qi)業(ye)會(hui)(hui)(hui)(hui)計部門(men),應按月編造由企(qi)業(ye)行政(zheng)方面或(huo)資方直接(jie)支付的勞動保(bao)(bao)險(xian)費用月報(bao)(bao)表,送經費審查委員(yuan)會(hui)(hui)(hui)(hui)審查后(hou),報(bao)(bao)請工會(hui)(hui)(hui)(hui)基層委員(yuan)會(hui)(hui)(hui)(hui)核轉省、市工會(hui)(hui)(hui)(hui)組(zu)織和(he)產業(ye)工會(hui)(hui)(hui)(hui)全國(guo)委員(yuan)會(hui)(hui)(hui)(hui)及當地人民政(zheng)府勞動行政(zheng)機(ji)關。直接(jie)支付勞動保(bao)(bao)險(xian)費用月報(bao)(bao)表應設下列各項目:
一、因工負傷醫療(liao)期間(jian)工資(zi);
二、疾(ji)病及非(fei)因工負傷醫療期(qi)間工資;
三、產假期間工(gong)資;
四、因工死亡(wang)喪葬費;
五、醫(yi)藥費與醫(yi)務經(jing)費;
六、療養所經費;
七、業(ye)余(yu)療養所經費;
八(ba)、營養(yang)食堂經費;
九(jiu)、托兒所(suo)及哺乳室經(jing)費;
十、其他支出。
第七(qi)十五(wu)條各(ge)級人民政府勞(lao)(lao)(lao)動(dong)行政機(ji)關(guan),對所轄地區(qu)內各(ge)企業的(de)(de)行政方面或資方及各(ge)級工會(hui)組(zu)織的(de)(de)勞(lao)(lao)(lao)動(dong)保(bao)(bao)險業務,應(ying)根(gen)據勞(lao)(lao)(lao)動(dong)保(bao)(bao)險條例第三十條的(de)(de)規定,實施監督與(yu)檢查,并得隨時(shi)檢查各(ge)企業實施勞(lao)(lao)(lao)動(dong)保(bao)(bao)險的(de)(de)狀況,調閱有(you)關(guan)勞(lao)(lao)(lao)動(dong)保(bao)(bao)險的(de)(de)各(ge)項帳冊、報表及其(qi)他有(you)關(guan)文(wen)件,如發(fa)現有(you)違(wei)反(fan)勞(lao)(lao)(lao)動(dong)保(bao)(bao)險條例事(shi)情,應(ying)即(ji)予以糾正(zheng),或報請上(shang)級勞(lao)(lao)(lao)動(dong)行政機(ji)關(guan)處理,必要時(shi),并得移送司法機(ji)關(guan)依(yi)法辦(ban)理。
第十八章附則
第七(qi)十(shi)六條(tiao)合于(yu)勞(lao)(lao)(lao)動(dong)保險(xian)(xian)條(tiao)例第二條(tiao)規(gui)定的企(qi)業,應由其工(gong)(gong)會(hui)(hui)基層委(wei)員(yuan)會(hui)(hui)與(yu)行(xing)(xing)政(zheng)方(fang)面或資方(fang),聯名向當地(di)(di)省、市人(ren)民政(zheng)府(fu)勞(lao)(lao)(lao)動(dong)行(xing)(xing)政(zheng)機關申(shen)請實行(xing)(xing)勞(lao)(lao)(lao)動(dong)保險(xian)(xian),經登(deng)記(ji)核準后,由工(gong)(gong)會(hui)(hui)基層委(wei)員(yuan)會(hui)(hui)用書面報告上(shang)級工(gong)(gong)會(hui)(hui)組(zu)織逐級轉(zhuan)報中華全(quan)國(guo)總工(gong)(gong)會(hui)(hui)備案(an)。但鐵(tie)路、郵電、兵(bing)工(gong)(gong)工(gong)(gong)會(hui)(hui)的全(quan)國(guo)委(wei)員(yuan)會(hui)(hui),得各自(zi)會(hui)(hui)同(tong)行(xing)(xing)政(zheng)方(fang)面,聯名向中央人(ren)民政(zheng)府(fu)勞(lao)(lao)(lao)動(dong)部申(shen)請實行(xing)(xing)勞(lao)(lao)(lao)動(dong)保險(xian)(xian),經登(deng)記(ji)核準后,立(li)即用書面報告中華全(quan)國(guo)總工(gong)(gong)會(hui)(hui)備案(an),其所屬的企(qi)業單位,不再(zai)向當地(di)(di)勞(lao)(lao)(lao)動(dong)行(xing)(xing)政(zheng)機關申(shen)請登(deng)記(ji)。
第七十七條(tiao)各省、市人民(min)政府勞動行(xing)政機關,應將各該地區業經(jing)批(pi)準實行(xing)勞動保險的(de)企業,報(bao)(bao)告上(shang)級(ji)勞動行(xing)政機關逐級(ji)轉報(bao)(bao)中央人民(min)政府勞動部備案。
第(di)七十八(ba)條勞動保險(xian)條例所稱“省、市工會”的市,系指中(zhong)央(yang)人民(min)政府直(zhi)轄市、大行(xing)政區行(xing)政委員會直(zhi)轄市及省人民(min)政府直(zhi)轄市而言(yan)。
第七十九條本細(xi)則由中央人民政(zheng)府勞(lao)動(dong)部公布施行,如有未盡事宜,得(de)由中央人民政(zheng)府勞(lao)動(dong)部隨(sui)時補(bu)充(chong)修(xiu)改之(zhi)。
